SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 42E be and it is hereby added
to Article '43 - Health, of the Annotated Code of Maryland
(1971 Replacement Volume and 1975 Supplement) to read as
follows:

Article 43 - Health

42E.

THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE MAY
REQUIRE HOSPITALS, SKILLED NURSING FACILITIES, AND
INTERMEDIATE CARE FACILITIES THAT PARTICIPATE IN THE
MARYLAND MEDICAL ASSISTANCE PROGRAM TO SUBMIT COST
REPORTS, AS DEFINED BY THE DEPARTMENT, WITHIN THE TIME
SPECIFIED BY THE DEPARTMENT. IF THE REPORTS ARE NOT
SUBMITTED WITHIN THE SPECIFIED TIME, THE DEPARTMENT SHALL
WITHHOLD FROM THE HOSPITAL, SKILLED NURSING FACILITY, OR
INTERMEDIATE CARE FACILITY UP TO 10 PERCENT OF CURRENT
INTERIM PAYMENTS FOR THE CALENDAR MONTH IN WHICH THE
REPORT IS DUE AND ANY SUBSEQUENT CALENDAR MONTHS UNTIL A
REPORT HAS BEEN SUBMITTED.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.
