appeal, the affirmance of the judgment, the entry of
judgment pursuant to Maryland Rule 875, or the
modification of the judgment without the award of a new
trial. For the purposes of this section, an appeal
stricken out pursuant to Maryland Rule 813, or
voluntarily abandoned, is deemed not to have been taken.
However, if the appeal so stricken out or voluntarily
abandoned was taken by the defendant, the plaintiff may
abandon the proceeding within 120 days after the appeal
is abandoned or stricken out, provided taking has not
occurred.

(b) Any hearing conducted pursuant to this title
shall be held in accordance with the provisions for
hearings in contested cases provided by the
Administrative Procedure Act. Appeals from final
decisions of the Archivist and further appeal to the
Court of SPECIAL Appeals shall be as provided in that
act. As part of the decision following any hearing, the
Archivist may charge any party with any portion of the
costs of the hearing.
SECTION 32. AND BE IT FURTHER ENACTED, That this
Act shall take effect July 1, 1976.
