4-2A05.

(f) The Secretary may issue a permit, under the
terms and conditions he prescribes, TO ALLOW any act
otherwise prohibited by subsections (c) and (d) for
scientific purposes or to enhance the [propogation]
PROPAGATION or survival of the affected species.

4-2A08.

(b) This section does not permit the possession,
transportation, exportation, processing, sale, offer for
sale or shipment within this State of species of fish
determined, pursuant to the Endangered Species Act, to be
an endangered or threatened species except as permitted
by § [4-2A09] 4-2A05.

4-1106.

(b) (4) If a vacancy occurs because a member is
unable or unwilling to serve[.], [The] THE Department
immediately shall notify in writing each member of the
committee of the vacancy. The committee shall arrange
for a new election to fill the vacancy. If the vacancy
is not filled within 60 days after the vacancy occurs,
the Department shall make the necessary appointments to
fill each vacancy. When committee members are selected
or when any vacancy is filled, the Department shall
notify promptly the members of the General Assembly from
the county of the names of the committee members selected
or appointed to fill a vacancy in that county. An
appointment to a vacancy in an unexpired term is limited
to the remainder of the term.

(b)   Any person who violates any provision of this
subtitle or any [regulation permit] REGULATION, PERMIT,
or order issued thereunder, is liable to a penalty not
exceeding $10,000, as well as being subject to being
enjoined as provided in subsection (a). The monetary
penalty thus provided may be recovered in a civil action
by the Department through the Attorney General.

7-6A01.

(c)  "Affected land" means the land from which the
mineral is removed by surface mining, and all other land
area in which the natural land surface has been disturbed
as a result of or incidental to the surface mining
activities of the operator, including private ways and
roads appurtenant to the area, land excavations,
workings, refuse piles, spoil piles, AND tailings.
