machinery, mobile cranes, ditch—digging apparatus,
well—boring apparatus, concrete mixers, and mobile homes
as defined in § 266EE-2 (g) of Article 41. The foregoing
enumeration shall be deemed partial and shall not operate
to exclude other such vehicles which are within the
general terms of this section.] A HIGHWAY AS AN INCIDENT
TO ITS NONHIGHWAY USE; OR

(3)         [[DESIGNATED AS SPECIAL MOBILE EQUIPMENT

BY THE ADMINISTRATOR]] OF A TYPE, INCLUDING BUT NOT

LIMITED TO, THAT IS A ROAD CONSTRUCTION OR MAINTENANCE

MACHINE, MOBILE CRANE, DITCH DIGGER, WELL DRILLER,

CONCRETE MIXER, JOB-SITE OFFICE VEHICLE OR PORTABLE POWER
GENERATOR.

(B)         "SPECIAL MOBILE EQUIPMENT" DOES NOT INCLUDE A

VEHICLE THAT IS:

(1)          DESIGNATED A FARM TRACTOR OR IMPLEMENT
OF HUSBANDRY; OR

(2)          OTHERWISE REQUIRED TO BE REGISTERED
UNDER THIS ARTICLE.

3-402.

(a) Every motor vehicle, trailer, semitrailer, and
pole trailer when driven or moved upon a highway shall be
registered under this part except:

[1.] (1) Any [such] vehicle driven or moved
upon a highway in conformance with the provisions of this
subtitle relating to manufacturers, transporters,
dealers, lienholders, OWNERS OR OPERATORS OF SPECIAL
MOBILE EQUIPMENT, or nonresidents or under a temporary
registration card issued by the [Department]
ADMINISTRATION;

[2.] (2) Any vehicle owned and used by     the

United States, unless registration of [such a]     THE

vehicle is requested by a duly authorized officer     or
employee of the United States;

[3.] (3) Any [special mobile equipment as
herein defined] FARM TRACTOR OR IMPLEMENT OF HUSBANDRY;

[4.] (4) Any vehicle whose front or rear
wheels are lifted from the highway, and any towed vehicle
attached to a towing vehicle by a tow bar and for which
no driver is necessary; [or]

[5.] (5) Any trailer or semitrailer having
a chassis weight not in excess of 1000 pounds, duly
registered in another state[,] but operated in intrastate
service within the State of Maryland, if the owner of the
trailer or semitrailer has registered annually in this
State a number of trailers or semitrailers equal to or in
excess of the average number of trailers or semitrailers
