And now here at this Day viz^t. y^e 24 Day of June Annoq Domⁱ. 1701 y^e Said
Thomas Tolley Appeares According to Indictment which was as followes

Rex	Kent Ss The Jurrors for our Soveraigne Lord y^e King that now is for
a^t.	y^e bodie of Kent County upon theire oathes Doe p^rsent Thomas Tolley
Thomas Tolley	for that he y^e Said Thomas Tolley y^e Twenty Ninth Day of Jan^ry Anno
	Domⁱ. 1700 Att Swan Creeke hundred in Kent County within y^e

Jurisdiction of this Court Together with Three Servant Men of him y^e Said Thomas
Tolley on y^e Kings high way there in A riatous Manner did assault y^e bodie of A Certain
Neale O’Neale and him y^e Said Neale O’Neale did beate wound & evill intreat and
other enormities comitted ag^t. y^e peace of our Soveraigne Lord y^e King and a^t. y^e force of
y^e Act of Assembly in that case made & provided       Macklin p^r Dom^s. Rege
To which Indictment y^e Said Thomas Tolley pleads not Guilty & for Tryall putts
himselfe upon God & y^e Country                 Tolley    p^r p^r
And he followes for our Lord y^e King Sayes he is Guilty       Macklin p^r Dom^s. Rege
Comand was Therefore given to y^e Sher^f. of Kent County that he cause to Come here Twelve
&^a. by whom &^a. who neither &^a. To recognize &^a. and y^e Said Sher^f. made
Answer he had there ready Twelve &^a. as by his precept he was Comanded viz^t.
Thomas Wyatt foreman Nicholas Massey Christopher Pinder William Sigley Henry
Green Nathan^ll. Cleave Thomas Carman Thomas Hynes Thomas Ruth Thomas
Ford Thomas Smith and John Ponder which Jury being duly Sworne to Try y^e Issue
Joyned and having heard y^e pleadings Evidence y^e Court giveth them theire Charge
who withdraw to Consider on y^e premisses and After Some Short time doe again[e]
returne and being Called over as alsoe y^e Defend^t. and being demanded whither y^e Said
Defend^t. was Guilty or not Guilty as he Stood Indicted doe Say that he is Guilty & by
Thomas Wyatt theire foreman all of them Soe Say

Therefore it is Considered by y^e Court here viz^t. this Twenty fifth Day of June Annoq
Domⁱ. 1701 in reguard that y^e Said Defend^t. Thomas Tolley has Submitted unto y^e Court as to
this Indictment goe thereof without Day paying his fees Amounting to y^e Sume of Eight
hundred & Six    pounds of Tob^o. Accrewing upon y^e Said Presentment

Richard Parnes Sone of Richard Parnes late of this County Dec^d. comes into Court &
makes Choice of Nicholas Hurt for his Guardian
