      Therefore it is Considered by y^e Court here viz^t. y^e 27 Day of March Annoq
Domⁱ. 1701 That y^e Said Plaint^f. Isaac Caulk doe recover from y^e Said Defendant as
well y^e Sume of five hundred forty & nine pounds of Tob^o. Debt as alsoe y^e Sum of
Two hundred Sixty and one pounds of Tob^o. Cost of Suite & y^e Said Will^m Rogers in mercy

   Comand was given to y^e Sher^f. of Kent County y^e 29. Day of Novem^r. Annoq Domⁱ.
1700 That he Take Thomas Tolly of Kent County Gentⁿ. if found in his bailiwick & him Safe
keepe Soe that he have his bodie before our Justices at a Court to be held for our Said County y^e
fourth Tuesday of Jan^ry next to Answer unto Henry Brailey of A plea of Trespass upon
y^e Case &^a.                                               Macklin p^r q^r.
Which next Court viz^t. y^e 28. Day of Jan^ry Annoq Domⁱ. 1700 being an Adjourned
Court all p^rcepts were cont^d. in y^e Sher^f. Custody untill y^e Eleventh Day of Feb^ry
following
On which Day viz^t. y^e Eleventh Day of Feb^ry Annoq Domⁱ. 1700 y^e day of y^e returne of
Said writt According to Adjournement came Elias King high Sher^f. of Said County & made
returne thereof in these words viz^t.       Cepi corpus p^r    Elias King Sher^f.
   But y^e Said Plaint^f. by his Said Att^ry Moves y^e Court that y^e Said Defend^t. Thomas
Tolly might find Esp^ll baile to Said Action which was granted unto him
The Said Plaint^f. Moves y^e Court likewise that y^e Said Defend^t. might be Comitted
into y^e Sher^f. Custody & there Custody & there to remaine untill he find baile
which was granted alsoe         Therefore Ordered That y^e Sher^f. of Kent County
doe Take into his Custody y^e bodie of y^e Said Thomas Tolley & there to remaine untill he
find Esp^ll. baile to Said Action                           Jn^o Dowdall Clk
Which cause was cont^d. & Said Defend^t. cont^d. in y^e Sher^f. Custody untill this p^rsent
Court and now here at this Day viz^t. y^e 27. Day of March Annoq Domⁱ. 1701 y^e Said
Plaintiff by his Said Att^ry Declⁿ viz^t.

Maryland Ss	Thomas Tolley of Kent County Gentⁿ. Stands Attached to Answer unto
Kent County	Henry Brailey of A plea of Trespass upon y^e Case

And whereupon y^e Said Plaint^f. by Richard Macklin his Att^ry Sayes y^t. whereas
y^e Said Plaint^f. at Biddeford in y^e Kingdom of Old England y^e tenth day of Octo^r.
An^o. Domⁱ. 1698 within y^e jurisdiction of this Court at y^e Sp^ll. instance & request of
y^e Said Thomas Did deliver Unto y^e Said Thomas Sundrey goods wares & merchandizes
to y^e value of Twenty four pounds Sixteen Shillings Ster^g. to be disposed of by y^e Said
Thomas in Maryland for y^e proper use & behoofe of y^e Said Plaint^f. And a returne
thereof in good Tob^o. in y^e Ship Called y^e Factor M^r. Yoe Master that p^rsent voyage
for England to be made And whereas alsoe y^e Said Plaint^f. on y^e Day & Yeare Afs^d. at
Biddeford Afs^d. within y^e Jurisdiction Afs^d. and at y^e like instance & request of y^e Said
Thomas did Sell & deliver unto y^e Said Thomas divers goods Amounting to y^e Sume of
fifteen pounds one Shill^g Ster^g. for which y^e Said Thomas did oblidge himselfe to pay y^e Said
Henry Brailey in Tob^o. in England in consideracon whereof y^e Said Thomas upon
himselfe
