      Therefore it is Considered by ye Court here vizt. ye 27 Day of March Annoq
Domi. 1701 That ye Said Plaintf. Isaac Caulk doe recover from ye Said Defendant as
well ye Sume of five hundred forty & nine pounds of Tobo. Debt as alsoe ye Sum of
Two hundred Sixty and one pounds of Tobo. Cost of Suite & ye Said Willm Rogers in mercy

   Comand was given to ye Sherf. of Kent County ye 29. Day of Novemr. Annoq Domi.
1700 That he Take Thomas Tolly of Kent County Gentn. if found in his bailiwick & him Safe
keepe Soe that he have his bodie before our Justices at a Court to be held for our Said County ye
fourth Tuesday of Janry next to Answer unto Henry Brailey of A plea of Trespass upon
ye Case &a.                                               Macklin pr qr.
Which next Court vizt. ye 28. Day of Janry Annoq Domi. 1700 being an Adjourned
Court all prcepts were contd. in ye Sherf. Custody untill ye Eleventh Day of Febry
following
On which Day vizt. ye Eleventh Day of Febry Annoq Domi. 1700 ye day of ye returne of
Said writt According to Adjournement came Elias King high Sherf. of Said County & made
returne thereof in these words vizt.       Cepi corpus pr    Elias King Sherf.
   But ye Said Plaintf. by his Said Attry Moves ye Court that ye Said Defendt. Thomas
Tolly might find Espll baile to Said Action which was granted unto him
The Said Plaintf. Moves ye Court likewise that ye Said Defendt. might be Comitted
into ye Sherf. Custody & there Custody & there to remaine untill he find baile
which was granted alsoe         Therefore Ordered That ye Sherf. of Kent County
doe Take into his Custody ye bodie of ye Said Thomas Tolley & there to remaine untill he
find Espll. baile to Said Action                           Jno Dowdall Clk
Which cause was contd. & Said Defendt. contd. in ye Sherf. Custody untill this prsent
Court and now here at this Day vizt. ye 27. Day of March Annoq Domi. 1701 ye Said
Plaintiff by his Said Attry Decln vizt.
Maryland       Ss    Thomas Tolley of Kent County Gentn. Stands Attached to Answer unto
Kent County    Henry Brailey of A plea of Trespass upon ye Case
And whereupon ye Said Plaintf. by Richard Macklin his Attry Sayes yt. whereas
ye Said Plaintf. at Biddeford in ye Kingdom of Old England ye tenth day of Octor.
Ano. Domi. 1698 within ye jurisdiction of this Court at ye Spll. instance & request of
ye Said Thomas Did deliver Unto ye Said Thomas Sundrey goods wares & merchandizes
to ye value of Twenty four pounds Sixteen Shillings Sterg. to be disposed of by ye Said
Thomas in Maryland for ye proper use & behoofe of ye Said Plaintf. And a returne
thereof in good Tobo. in ye Ship Called ye Factor Mr. Yoe Master that prsent voyage
for England to be made And whereas alsoe ye Said Plaintf. on ye Day & Yeare Afsd. at
Biddeford Afsd. within ye Jurisdiction Afsd. and at ye like instance & request of ye Said
Thomas did Sell & deliver unto ye Said Thomas divers goods Amounting to ye Sume of
fifteen pounds one Shillg Sterg. for which ye Said Thomas did oblidge himselfe to pay ye Said
Henry Brailey in Tobo. in England in consideracon whereof ye Said Thomas upon
