Comand was given to ye Sherf. of Kent County ye 24. Day of Sepr. Annoq Domi
1700 That he Take Wm Roggers alius dictus William Rogers of Said County planter
if found in his bailiwick and him Safe keepe Soe that he have his bodie before his magties
Justices at ye next Court to Answer unto Isaac Caulk of A plea of Debt &a.
Comand was likewise to ye Said Sherf. of Kent County ye 29. Day of Novemr. Annoq

Planter if found in his bailiwick & him Safe keepe Soe that he have his bodie before
his majties Justices at ye Next Court to answer unto Isaac Caulk of A plea of Debt
Which next Court vizt. ye 26 day of Novemr. Annoq Domi. 1700 as alsoe ye 28. day of
Janry Anno Domi. 1700 ye days of ye returnes of Said Writts came Elias King
high Sherf. of Said County & made returne of first writt viz. N. E. I. pr E K S.
The 28. Day of Janry 1700 being ye day of ye returne of Said Second writt ye Said
Court was Adjourned untill ye Eleventh Day of Febry following Att which Day being
ye Day of ye returne of Said Second writt According to Adjournemt. came Elias King
high Sherf. of Said County and Made returne thereof in these words vizt.
                                                                  Cepi corpus    Elias King Sherf.
On which Day vizt. ye 28. Day of Janry Annoq Domi. 1700 ye Said Defendt. William
Rogers in his proper person Appeares and prayes thereof to Imparle untill ye Next
Court which was granted unto him ye Same Day was given ye Plaintf. likewise
                                                                            Earle pr qr.
And now here at this Day vizt. ye 27. Day of March 1701 ye Said Cause Standing for
Tryall ye Plaintf. Decln. vizt.
Kent County    Ss    William Ragers alius Dictus Wm Rogers of Said County Planter
in Maryland    was Sumoned to Answer unto Isaac Caulk of Same County of A plea

   that he render unto him the full & just Sume of five hundred

   forty & nine pounds of good Sound Merchantable Tobo. in casque

   which to him he oweth & from him he unjustly detaines
And whereupon ye Said Isaac by Michael Earle his Attry Saith that whereas ye Said Wm
on ye Seaventh Day of Apll. Annoq Domi. 1700 in Said County within ye Jurisdiction of this
Court by his Certaine bill or writing obligatory Sealed with his Seale as his Act & deed deliver
:ed & here in Court brought whose date is ye Same day & yeare did bind himselfe his heires
Exrs. & Adrs. to pay or Cause to be well & Truly paid unto ye Said Isaac his heires Exrs
Adrs. or Assignes ye Said Sum of five hundred forty & nine pounds of Tobo. quallified as
Afsd. Convenient on Chester River at or upon ye Tenth Day of Octobr. next ensuing ye Date of ye
Same bill Yet notwithstanding ye Said William ye Said Sume of five hundred forty &
nine pounds of Tobo. According to ye Tenr. of ye Same bill unto ye Said Isaac he hath not paid
although often demanded but ye Same to pay he hath denyed & refused And Still doth deny &
thereupon he brings this Suite                 Earle pr qr.
And ye Said Plaintf. by his Said Attry prayes that ye Said Defendt. Wm Rogers might
come into Court & Make Answer to his Said Decln. who neither by himselfe nor Attry Appearing
Judgt. was given at. him by ye Court by Default for ye Said Sume of five hundred forty &
nine pounds of Tobo. Debt and Cost Accrewing thereon
