March Court 1701 39 Whereas Phillip Holeidger of Ceecill County Planter for Stealing A horse belonging to Wm Hollinsworth was prsented by ye Grand jury this Court which prsentment was framed into A bill of Indictment and being Tryed by A jury was found Guilty but ye Court have Contd. passing Judgemt. at. him untill next Court And Richard Macklin Clk of ye Indictments Moves ye Court that ye Said Phillip may enter into recognizance wth. good & Suffitient Security for his Appearance here at ye next Court & good behaviour in ye meane time wch. was granted Ordered Therefore by ye Court that ye Sherf. of this County doe Take into his Custody ye Said Phillip Holeidger & there to remaine untill he Enter into recognizance with good & Suffitient Security for his personall Appearance at ye next Court and good Abearance in ye meane Time Jno Dowdall Clk But ye Said Phillip comes into Court Together wth. Samll. Wallis & Abraham Ambross Junr. his Securities and ye Said Phillip doth Acknowledge himselfe to owe & Stand justly Indebted unto our Soveraigne Lord King Wm ye Third his heires & Successors in ye full & just Sume of Twenty pounds Sterg. to be leavied upon him lands & Teniments Goods & Chattles Condiconed he make not his personall Appearance at ye next Court and be of good behaviour & abearance to all his Majties Leidge Subjects in ye meane time And ye Said Samll. Elias King as Exr. of ye Exr. of Richard Sweatnam and ye Said Elias King by Richard Macklin having Demurred to ye Decln. of ye Said John Sweatnam and Some of ye reasons being argued ye Said Case was Contd. wth. ye Consent of Plaintf. and Defendt. untill next Court Leiut. Coll. Thomas Smith & Mr. Charles Hynson Sitts William Robinson Sweares to 3 days Attendance as an Evidence on behalfe of Walter Smith platf against Thomas Prestage Defendant Comand was given to ye Sherf. of Kent County ye Thirteenth day of Febry Annoq Domi. 1700 that he Take Charles Hollinsworth Junr. if found in his bailiwick & him Safe keepe Soe that he have his body at ye next Court to be held for Said County at our Court house upon Chester River to Answer unto Joshua Sweatnam of A plea of Trespass upon ye Case &a. Att which next Court vizt. ye Twenty fifth day of March Annoq Domi. 1701 ye Day of ye returne of Said writt came Elias King high Sherf. of Said County & made Returne of Said writt thus Endorsed vizt. Cepi Corpus pr Elias King Sherf And ye Said Defendant by Richard Macklin & Michael Earle his Attrys Appeares and move ye Court that ye Said Plaintf. Joshua Sweatnam being A foraigner may come into Court & give Security for ye payment of ye Costs Accrewing upon ye Said Action in case he doe not prosecute it with Effect which was by ye Court Granted Ordered Therefore that Joshua Sweatnam being noe Inhabitant of this County & having comenced An Action at. Charles Hollinsworth Junr. one of ye livers in this County that ye Said Joshua doe put in Security to pay ye Costs Accrewing thereon if he does not mentaine his Action According to Order of this Court Jno Dowdall Clk But ye Said Plaintf. Joshua Sweatnam neither by himselfe nor Attry Appearing to either put in baile to pay costs if he does not mentaine his Action or to prosecute ye Same ye Said Defendt. by his Said Attrys moves ye Court for A Nonsuite which was Granted |
