Comegys Plaintf. doe recover from ye Said Defendant Hugh Marsh as well Two gunns well fixed Stock & lock as alsoe ye Sume of three hundred and eleven pounds of Tobo. cost of Suite & ye Said Hugh in mercy ~~~~~~~~~~~~~~~ Jno Dowdall Clk David Murphey comes into Court & Sweares that he has Attended as an Evidence for Joshua Sweatnam ast. Thomas Crafts ye Space of Three days ~~~~~~~~~~~~~~~ Danll. Perey being bound by Recognizance to make his personall appearance here at this Court & good behaviour in ye meane time now appeares & is Cleared by prclama :tion ~~~~~~~~~~~~~~~ Vincent Hemsley of Talbott County comes into Court & proves an Acct. ast. Edward Smith late of Kent County Decd. for ye Sume of Two Thousand Three hundred pounds of Tobo and that there is due upon balle. ye Sume of Twelve hundred ninety & four pounds of Tobo. ~~~~~~~~~~~~~~~ Comand was given to ye Sherf. of Kent County ye 28. day of March annoq Domi. 1701 That he Take Lawrence Grose if found in his bailiwick & him Safe keepe Soe that he have his body at ye next Court to be held for Said County before his Majties Justices to answer unto John Hyde of A plea of Trespass upon ye Case Att which next Court vizt. ye 24 day of June ye day of ye Returne of Said writt came Elias King high Sherf. of Said County & made returne thereof in these words vizt cepi corpus pr Elias King Sherf. But ye Said Plaintf. by Richard Macklin his Attry moves the Court that ye Said Defendt. Lawrence Grose may find Espll. baile to Said Action & comitted unto ye Sherf. Custody untill he find baile which was granted And ordered that ye Sherf. of Kent County doe take into his Custody ye body of ye Said Lawrence Grose & him Safe keepe untill he find Espll. baile to Said action ~ ~ ~ ~ ~ ~ ~ Jno Dowdall Clk And ye Said Defendt. comes into Court & brings Robert Smith Esqr. along with him who assumes that ye Said Defendt. Lawrence Grose Shall pay Condemnacon if Cast or else he will doe it for him On which Said day ye Said Defendt. by Michael Earle his Attry Appeares & prayes thereof to Imparle untill ye next Court which was granted him ye Same day was given ye plaintf alsoe And now here at this day vizt. ye 27. day of Novemr. Annoq Domi. 1701 came as well ye Said Defendt. by his Said Attry as alsoe ye Said Plaintf. by Richard Macklin his Attry & ye Said cause Standing for Tryall ye Plaintf. Decln Maryland Ss Lawrence Grose of Kent County Stands Attached to answer unto John Hyde of Kent County a plea of Trespass upon ye Case And Whereupon ye Said John Hyde by Richard Macklin his Attry complaines that whereas ye Said John Hyde ye 23d. day of October Anno Domi. 1697 and at divers other days & times afterwards at London in ye Kingdom of old England within ye jurisdiction of this Court at ye Spll instance and request of ye Said Lawrence and for ye proper Use Service & behoofe |
