Day of Augt. following that he Take Jeremiah Smith alius Dictus Jeremiah Smith of St. Paules parish Weaver if found in your bailiwick & him Safe keepe Soe that you have his body before his Majties Justices at ye next Courts to be held for Said County to answer unto John Lillingston of ye Same parish Clk of A plea that he render unto him ye Sume of Twenty five Shillings Sterg. which &a. Non East Inventus pr me Elias King Sherf But a Copie of ye Decln. being Sent along wth. ye writt was as followeth vizt Kent Ss Jeremiah Smith aliuas Dictus Jeremiah Smith of St. Paules parrish weaver Stands Attached to answer unto John Lillingston of ye Same parrish Clk of A plea that he render unto him ye Sume of Twenty five Shillings Sterg. which to him he oweth & from him he unjustly detaineth And whereupon ye Said John Lillingston by Richard Macklin his Attorney Saith that whereas ye Said Jeremiah Smith on ye 4th. day of Febry Anno Domi. 1700 at Talbott County within ye jurisdiction of this Court by his certaine bill or writing obligatory Sealed wth. his Seale as his act & deed Delivered & here in Court brought whose date is ye day & yeare Afsd. did bind himselfe to pay unto John Lillingston ye Said Sume of Twenty five Shillings Sterg. upon demand After ye date of Same bill or writing obligatory Yet Notwithstanding ye Said Jeremiah ye Said Sume of twenty five Shillings Sterg. according to ye Tenr. of ye Same bill or writing obligatory unto ye Said John Lillingston he hath not paid altho often Demanded but ye Same to pay he hath denyed and as yet doth deny and refuse and Unjustly detaine to ye Damage of ye Said John Lillingston fifty Shillings Sterg. and thereupon he brings this Suite Macklin pr qr. pleadges &a. Jno Doe Rd. Roe Which Said Decln. being read and ye Sherf. having returned two Non Easts upon ye writts & a Copie of ye Decln. being Sent wth. ye writts according as ye Law requires ye Said plaintf. by Richard Macklin his Attry comes into Court & prays Judgement for an Attachmt. for ye Afsd. Debt & cost of Suite which was by ye Court granted Therefore it is considered by ye Court here that ye Said Plaintf. John Lillingston have Attachmt. agt. ye goods Chattles &a. of ye Said Defendt. Jeremiah Smith as well for ye Sume of one pound five Shillings Sterg.
