(375 Pounds Nine Shillings and one penny Sterling Money with Interest thereon from the fourteenth day of August last as by his Bond or Obligation for payment of the same bearing equal date herewith will more fully appear And Whereas the said Daniel Carroll desirous of securing the said Charles Carroll in the payment of the said sum of Money with Interest hath agreed to execute these presents Now this Indenture Witnesseth that the said Daniel Carroll in pursuance of such Agreement and in Consideration of five Shillings Current Money of Maryland to him in hand paid by the said Charles Carroll at or before the Sealing and delivery of these presents the Receipt whereof is hereby Acknowledged Hath granted bargained Sold Aliened and Confirmed and by these presents Doth Grant bargain sell alien and Confirm unto the said Charles Carroll of Carrolton his Heirs and Assigns All Those the said four hundred Acres of' Land above described Together with all Buildings Erections and Improvements thereon made ways alleys Roads waters water Courses Trees woods Advantages Emoluments Rights Members and Appurtenances thereunto belonging or in any wise appertaining and the Reversion and Reversions Remainder and Remainders Rents Issues and profits thereof And all the Estate Right Title and Interest property claim and demand whatsoever of him the said Daniel Carroll therein or thereto To Have and To Hold the said four hundred Acres of Land and premises herein before granted and Conveyed with the appurtenances unto the said Charles Carroll of Carrolton his Heirs and Assigns to the only proper use and behoof of him the said Charles carroll of Carrolton his Heirs and Assigns for Ever Provided Nevertheless and it is the true intent and meaning of the said parties and of these presents that if the said Daniel Carroll his Heirs Executors Administrators or Assigns do and shall well and truly pay or cause to be paid unto the said Charles Carroll of Carrolton his Executors Administrators or Assigns the said full Sum of four hundred and Eighty five Pounds Nine Shillings and one penny Sterling Money with Interest for the same on the first day of December next ensuing the date of these Presents according to the Condition of the above mentioned Bond bearing even date with these Presents without any deduction whatsoever then this present Indenture and every thing therein Contained shall Cease determine and become absolutely void And the said Daniel Carroll doth hereby for himself his Heirs Executors Administrators or Assigns shall and will well and truly pay or Cause to be paid unto the said Charles Carroll of Carrolton his Executors Administrators or Assigns the said sum of four hundred and eighty five pounds Nine Shillings and one penny Sterling Money with Interest as aforesaid on the day herein before limited for payment thereof without any deduction or abatement whatsoever And Lastly that he the said Daniel Carroll at any time or times after default in payment shall happen to be made of the said Sum of Sterling Money and Interest shall and will upon the request and at the charge of the said Charles Carroll of Carrolton his Heirs or Assigns make do acknowledge and Execute all such further and other Acts Deeds and Conveyances for the further and more Effectually |
