547) One hundred acres more or less; & also all that other Tract of plantable Land called Gareys Security lying in Talbot County on the North side of S.t Michaels River & on the South side of a Creek in the said River called Leeds Creek containing One hundred and twenty four acres more or less together with all Edefices Buildings Improvements Commodities priveledges advantages and appurtenances whatsoever to the af.d Several Tracts or parcells of Lands belonging or in anywise appertaining and the Reversion and Reversions Remainder and Remainder Rents Issues and profits thereof and each of them and every part thereof and also all the Estate Right Title Interest Use Trust property Claim and Demand whatsoever of him the same William Garey of in to or out of the aforesaid Tracts or parcells of Land and every of them To have and to hold the said Several Tracts or parcells of Land and all and singular the premisses with the appurtenances unto the same Edward Lloyd his Heirs and Assigns To the Intent and purpose that the said Edward Lloyd may be and become perfect Tenant of the Freehold and Inheritance of the said premisses that a Common Recovery or recoveries may be had and suffered against him the said Edward Lloyd in such manner as is herein after mentioned And for that purpose it is hereby covenanted granted and agreed by and between all the said parties to these presents that before the end of this present April Provincial Court one or more Writ or Writs of Entry sur Disseisin en le post at the Costs and Charges of the said William Garey shall and may be brought and prosecuted against him the same Edward Lloyd in the name of the said James Tilghman as plaintiff or Demandant therein of and for the aforesaid several Tracts & parcells of Land and all and singular the premisses with the appurtenances by such name or names Quantities Qualities Numbers or Content of Acres or other certainties and descriptions as shall be apt and convenient in that behalf; to which Writ or Writs the said Edward Lloyd shall and will appear gratis in his proper person or by his Attorney or attornies lawfully authorised and shall and will enter into the said Warranty and vouch over to warrant the Same premisses with the appurtenances the Common Vouchee who shall thereupon appear and enter into the said Warranty and after Imparlance make Default and such further and other proceedings shall be therein so that one or more good and perfect Common Recovery or Recoveries with double Vouchee for assurance of Lands in such Case used and accustomed may be had perfected and executed And it is hereby further covenanted concluded granted declared and fully agreed by and between all the said parties to these presents that from and immediately after the suffering and perfecting the said Recovery or Recoveries as well these presents and the Assurance hereby made as also the Common Recovery or Recoveries so as aforesaid or in any other manner to be had suffered and perfected shall be and enure and shall be adjudged construed deemed and taken and is & are & was and were meant and intended and is and are hereby declared to be and enure and the Recoveror or Recoverors in the said Recovery or Recoveries named or to be named & he and they and his & their Heirs shall |
