704 Property Possession Claim and Demand whatsoever of him the said Benjamin Beall and his Heirs of in and to the same To Have and to Hold all the said Tract of Land with the Improvements Advantages and Appurtenances to him the said Ninian Beall his Heirs and Assigns to the only proper use and behooff of him the said Ninian Beall his Heirs and Assigns and to or for no other use Intent or Purpose whatsoever and the said Benjamin Beall doth Covenant and Agree to and with the said Ninian Beall that he the said Benjamin Beall his Heirs Executors and Administrators the said Tract of Land hereby Bargained and Sold with all and every of their Rights Members and Appurtenances unto the said Ninian Beall his Heirs and Assigns against all and every person and Persons whatsoever shall and will for ever hereafter well and truly Warrant and Defend free and Clear of and from every Incumbrance and Charge whatsoever And the said Ninian Beall that he the said Benjamin Beall and his Heirs shall and will at all times hereafter at the reasonable request and the proper Costs and Charges in the Law of him the said Ninian Beall or his Heirs or Assigns make do suffer and Execute and Cause to be made done suffered and Executed all such further and other Act Acts Deed Deeds Assurance Assurances Conveyances and other things as shall by the said Ninian Beall his Heirs or Assigns or his or other Council Learned in the Law be reasonably devised advised or required for the better and more perfect Assuring unto the said Ninian Beall his Heirs & Assigns a good sure and indefeazeble Right of Inheritance in Fee Simple in and to the said Parcel of Land hereby Conveyed or intended to be Conveyed In Witness whereof the said Benjamin Beall hath hereunto set his hand and Seal the day and Year above Written Sealed and Delivered in the Presence of us the words (or Parcel) interlined between the Sixth and seventh Line Jos.a Beall Benjamin Beall (Seal) Chris.r Lowndes On the Back of the aforegoing Deed was thus Endorsed Viz.t Received the Eleventh day of April Seventeen Hundred and Seventy from the within ^named^ Ninian Beall son of Ninian Junior Current Money being the Consideration within mentioned Witness my hand Testes Jos.a Beall Benjamin Beall Chrn.r Lowndes Maryland Prince Georges County fs.t Be it Remembered that on the Eleventh day of April Seventeen hundred and Seventy before us the Subscribers two of his Lordships Justices of the Peace for the County aforesaid personally appeared Benjamin Beall son of Ninian Jun.r party to the within Instrument of Writing and Acknowledged the same to be his Act and Deed and the Lands and Premises therein mentioned to be the Right and Estate of the within Named Ninian Beall son of Ninian Jun.r according to Intent and Meaning of the same Deed and the Acts of Assembly in such Cases made & Provided (On) |
