(485) from Time to Time receive according to the purport Meaning Tenour or Effect of the said Commission then the above Obligation to be Void and of none Effect else to be in full Force and Virtue Sealed and Delivered Dan of S.t Tho.s Jenifer (Seal) in the presence of T Ridout (Seal) James Brooks Fred Stone J Hall (seal) Recorded the 1.st Day of December 1768 3 sides Examd This Indenture made this third Day of December in the Year of our Lord Christ one thousand seven hundred and sixty eight Between Joseph Ensor of Baltimore County in the Province of Maryland of the one part and Charles Carroll Esquire of Carolton of the City of Annapolis and Province aforesaid of the other part Whereas the said Joseph Ensor by his Deed of Indenture bearing Date on or about the ninth Day of April in the Year of our Lord seventeen hundred and sixty four and made or mentioned to be made between the said Joseph Ensor of the one part and a certain John Brice Esquire of the City of Annapolis of the other part after sundry Recitals therein contained and expressed did for and in consideration of the sum of fifteen hundred Pounds Sterling Money of Great Britain to him in hand paid by the said John Brice give grant bargain sell alien set over transfer and confirm unto him the said John Brice his Heirs and Assigns All that Tract of Land lying and being in Baltimore County called East Humphreys containing three hundred Acres and also the undivided Moiety or half of a Tract of Land lying and being in Cæcil County called Bohemia Manor granted originally to Augustine Herman on the fourth Day of September sixteen hundred and eighty two according to the Metes and Bounds as described in a Deed of Mortgage recited in the said Indenture bearing Date the twenty fifth Day of January seventeen hundred and sixty three and also one Tract or parcel of Land lying and being in Baltimore County called Seedticks Plenty containing two hundred and fifteen Acres and an half Acre being the then dwelling Plantation of the said Joseph Ensor and also seventy five Acres part of one other Tract of Land lying and being in Baltimore County called Mount Pleasant granted to a certain Nicholas Hale of Baltimore County aforesaid on or about the tenth Day of January seventeen hundred and five and also twenty Acres of Land lying and being in the County last aforesaid which was Condemned for a Grist Mill by William Fell who is since deceased and John Ensor Senior In which said Indenture there was contained a Proviso That in Case the said Joseph Ensor his Heirs Executors or Administrators should pay to the said John Brice his Executors Administrators or Assigns the sum of fifteen hundred Pounds Sterling with Legal Interest thereon from the date of the aforesaid mortgage until the tenth Day of April that should be in the year of our Lord seventeen hundred and sixty six that then the Indenture or Deed of mortgage to be Void otherwise to (remain) |
