(7) Diana Conaway being examined Seperate and apart from her said Husband whether she was compelled to execute the said Deed ^by^ threats or menaces of her said Husband who answered that She was not But that it was her own Voluntary Act and Deed and that she freely and without any Compulsion whatsoever quitted and Released her Claim to all her Right of Dower in the Premisses within mentioned unto the said John Gill his Heirs and Assigns for ever Jn.o Brice August the 7.th 1759 Received of M.r John Gill five shillings and Six pence half penny Sterling for his Lordships Use (it being the Alienation fine on the within mentioned Lands) by Virtue of a Commission from Edward Lloyd Esq.r 9 1/2 sides his Lordships Agent and Receiver General Rich.d Dorsey Recorded 7.th August 1759 E.d Whereas Nicholas Maccubbin of the City of Annapolis Merchant on on the fourteenth day of March One thousand seven hundred and fifty eight agreed with me the under written Charles Todd that in case I should by the 25.th day of December then next ensuing pay the Consideration Money Mentioned in the ^a^ Deed I made to him for the Land I then lived upon together with the Interest arising due thereon that then he promised to release his Right of said Land to me To the Performance whereof he bound himself and his Heirs And Whereas I have requested John Brice of the city aforesaid to pay the Consideration Money aforesaid and Interest thereon and that the Said Maccubbin convey all the said Lands to the said John Brice in consideration whereof the said Brice is to have an Absolute Estate in Fee Simple of in and unto the said Lands and to receive the rents and Profits thereof Subject Nevertheless to this Provisoe that after the said John Brice shall deduct the Yearly Interest together with the charge of the repair of the Houses and the charge of Drawing and Recording the Deed from the said Maccubbin to him and the Alienation Fine he shall pay thereon The said John Brice shall account with me Charles Todd for the Yearley Rents so far as he shall receive untill the last day of November which shall be in the year of our Lord One thousand seven hundred and Sixty two but not to be liable for them unless he shall actually receive the same Money therefor At which 30.th day of November 1762 if the said Charles Todd shall pay the Ballance of the Consideration (Money) |
