(1) [illegible] This Indenture made the thirtyeth day of Oct.r Anno Domi 1709 Between Aquila Paca of Baltemore Gentl son and heir of Rob.t Paca son sometime of Ann.ll County deced of the other part & Sam.l Chew Jun.r of Ann.ll County March.t of the other part Wittnesseth that the s.d Rob.t Paca by deed Indented bearing date the sixth day of June 1677 Granted bargained and sold for the consid.n therein Menconed one Joseph Taylor ^of London Merch.t^ all that peice or parcell of Land lying & being at Norring Creek in y.e s.d Co.ty of Ann.ll being part of a divident of Land formerly Laid out for Co.l Edward Carter and now in the actuall possession of the said Sam.l Chew with provisoe that if the said Rob.t Paca his heirs ex.rs or adm.rs should pay unto the said Joseph Taylor his certaine attorney ex.rs or adm.rs the said consideration at certaine days and times in the said Deed Menconed that then the said Bargaine and Sale should be Void But for that the said consider.a nor any part thereof was paid by the said Rob.t Paca in his Lifetime nor by the said Aquila Paca nor any other person whatsoever since his death the s.d Aquila Paca for and in consider.a thereof and of the sum of thirty pounds ster money to him in hand paid by the s.d Sam.l Chew the Receipt whereof he doth hereby acknowledge and of all and every part thereof by these presents doth acquitt Exonerate and Discharge him y.e s.d Sam.l Chew his heires ex.rs adm.rs and assignes Hath Given Granted Remised released and for ever acquitt claimed and confirmed and by these presents doth Give Grant remise release and for ever Quitt Claim and Confirme unto the s.d Samuel Chew (in his actuall poss.n being by Virtue of severall Mesne assigne from the said Joseph Taylor) his heires and assignes all that the said Peice and Pcell of Land (Cont.a three hundred ^acres^ or thereabouts) and all houses and other heriditaments to the same belonging or any ways appert.a and all the Estate Right title and Interest of him the said Aquila Paca his heires and assignes out of in & into all & every part of the premises To have and to hold the said Peice and Parcell of Land bering part of the s.d Carters Land cont.a three hundred a or thereabouts & all houses and other heriditaments to the same belonging or in any ways appert.a unto the said Sam.l Chew his heires ^and assignes^ for ever to the only proper use and behoofe of him the said Sam.l Chew his heires & assignes for ever more and the said Aquila Paca for himself his heires ex.rs and adm.rs doth by these presents covenant grant and agree to and with the said Sam.l Chew his heires and assignes that for and notwithstanding any act or thing done by him the said Aquila Paca to the contrary the said Samuel Chew his heires shall and may for ever hereafter have hold Posess and Enjoy all & every the hereby Granted and Released Land and premises In Wittness whereof the parties to these presents hereby have interchangably set their hands and seales the day & year first above written signed sealed & d.d in psence of us Aquila Paca (sea) W.m Holland Samuel Harrison James Heath on y.e back of y.e s.d Deed was thus Written Viz.t Mem.d the 30.th day of Oct.r 1709 Came before me W.m Holland Esq.r Chief Just of her Mag.tys province of Maryland y.e within named Aquila Paca and acknowledged the within deed & the Lands therein named to be the Right of the there named Sam.l Chew his heires & assignes for ever W.m Holland |
