727 said Cred.rs & Legatees in such Manner & forme as the said Comisary Gen.ll shall direct & appoint And for the satisfaccon of the Remainder of the Debts and Legacys if it shall not appear there is assetts in the hands of the said Executor sufficient to pay & discharge the same that then in such Case the said Land plantation & p.rmises so given to the Charitable uses aforesaid be & are hereby made liable & subject to the paym.t & satisfaccon thereof as farr as they will go to the discharge thereof by the sale of the same Lands plantation & p.rmisses To which purpose it is hereby first here enacted by the Authority afd that the said Overseers of the said Will & here in this Act particularly named or the survivor or survivors of them be & are hereby authorized & appointed to be Trustees as soon as possibly they can to sell & dispose of the said plantacon land & premisses or any part thereof to such person or persons as will give most for the same to raise mony & Tobacco to pay & discharge the Debts & legacys remaining due & unpaid so farr as the same shall amount unto as afd They the said Overseers & Trustees afd from time to time Rendring also to the said Com.ry Gen.ll for the time being a just & true acc.t of all the mony or Tobb.o by them recd by such sale by them the said Trustees or the survivor or survivors of them that he may soe that the same may be employed & paid to the Cred.rs & Legatees afd And such sale by them the said Trustee or the survivor or survivors of them to be made & executed to any person or persons whatsoever to be holden as firm & good in law to all intents & purposes to the purchaser or purchasers of the same & their heires & assigns for ever ag.t all person or persons ^whatsoever^ claiming by from or under the said Walter Hall Mark Cordea John Barnes or any of them their or any of their heires or assignes ^or against y.e said Anthony Lumbrosy and William Burley or their heires or assignes^ Notwithstanding the loss of the Writings afd or any other Defect in law in the penning or Executing of the same or any law or statute to the Contrary in any wise Notwithstanding And if it shall happen that ^all^ the said Debts & Legacys paid & Dischargd as afd there shall any surplus of mony or Tob.o remaine in the hands of the said Trustees (their reasonable Charges being first dedicated) they the said Trustees are hereby ordered to pay & Dispose of the same to the uses in the said last Will of the said Mark Cordea mencond September 29.th 1696 Assented to by his Ma.ties hon.ble Councill Henry Denton Cl Concil |
