       such offender be in our actuall service and borne on and in pay on board any such our ships of warr or other
       vessells acting by Immediate Commission or warrant from our Commissioners for Executeing the office of our
       high Admirall or our high Admirall as afd for as he shall not receive any Protection for the Avoyding of Justice
       for such Offences Committed on shoare from any pretence of his being employed in our service at sea Wee doe
       hereby Give you full power and Authority to appoynt fayres Marts and Marketts as allsoe such and soe many
       Ports Harbours Bays Havens and other places for the convenience and security of shoping and for the better loading
       and unloading of Goods and M.rchandizes as by you with the advice and Consent of the said Councill shall be
       thought fitt and Necessary and in them or any of them to Erect Nominate and Appoynt Custome houses to toare
       houses and Officers relateing thereunto and them to alter Change or displace from time to time as with the advice afd
       shall be thought fitt Wee doe further by these p.rsents Command you to take all possible Care for the discountenance  
       of vice and Encouragement of Virtue and good living that by such Examples the Infidells may be Invited and
       desire to pertake of the Christian Religion And Wee doe hereby require and Command all officers Civill and Military
       and all other Inhabitants of our said Province and Territory to be Obedient Aiding and Assisting unto you the said
       Francis Nicholson Esq.r in the Execution of this our Commission and of the Powers and Authorityes therein Contained
       and in Case of Yo.r Death or abscence out of our said Province to be obedient aiding and Assisting unto such pson as shall
       be appoynted by us to be Commander in Cheife to whome wee doe therefore by these p.rsents Give and Grant all and
       singular the powers and authorityes to be Executed and Injoyd by him during our Pleasure or untell yo.r arrivall
       within our said Province of Maryland Provided always that Nothing herein Contained shall be Construed
       or Taken to diminish or alter the Powers formerly Granted to our Trusty and well beloved S.r Edmond Andross Knight
       by our Commission unto him bearing date the third day of March one thousand six hundred ninety one in the fourth
       year of our Reigne but that the said S.r Edmond Andross upon the Death or abscence from America of you the said
       Francis Nicholson shall take upon him the Cheife Command of our said Province and Execute the Powers of this our
       Commission as wee doe hereby likewise will and Command that our Commission bearing date the fourteenth day of
       November in the first year of our Reigne Constituting you our Leiuetenant Gov.r of our Dominion and Collony of
       Virginia doe Cease and determine from the date of these p.rsents except upon the Death or absence from America
       of the said S.r Edmond Andross In which case our will and pleasure is that you take upon you the Cheife Command
       of our said Dominion and execute the Powers of our Commission Given to the said S.r Edmond Andross untill our
       further pleasure be knowne And if upon the death or abscence of you the said Francis Nicholson out of our said
       Province of Maryland there be noe pson Commissionated or appoynted by us to be Commander in Cheife of our said
       Province our will and Pleasure is that the their ^p.rsent^ Councill of that our Province doe take upon them the administration
       of the Governmt and Execute this Commission and the severall Powers and Authorityes therein Contained and that
       the first Councello.r who shall be at the time of Yo.r Death or abscence resideing within our Province of Maryland doe Reside
       in our said Councill with such Powers and Preleminencyes as any former P.rsident hath used and enjoyed within our said Province
       or any other our Plantations in America untill our pleasure be further knowne or yo.r arrivall as afd Lastly wee
       doe hereby declare Ordaine and Appoynt that you the said Francis Nicholson shall and may hold Execute and Enjoy the
       office and place of Captaine Gen.ll and Governo.r in Cheife in and over our Province and Territory of Maryland Together w.th all
       and singular the Powers hereby Granted unto you for and during our will and pleasure In Wittness whereof wee have
       caused these our Lett.rs to be made Pattentes Wittness our selves at Westminster the Tenth day of Feb.ry in the fifth year
       of our Reigne
