746 (736 This Indenture mad the Ninteenth Day of May one thousand six hundred Ninety and six Between James Murphy and Mich.ll Turbutt both of Talbot County gen.t Ex.rs of the Last will and Testement of Coll Vincent Lowe late of the said County deceased of the one part and Coll Henry Darnall of Calvert County Esqr of the other part Wittnesseth that y.e said James Murphy and Mich.ll Turbett as Ex.rs of the Last will and Testement of the said Coll Vincent Lowe and by vertue of the same and the power thereof Conferred upon them to make sale of severall lands herein Mentioned for the payment of such debts as were oweing from him the said Coll Vincent Lowe at the time of his death as by the will upon Record in the Comis.ry Gen.lls office whereon being thereunto had it may appeare and for & in Consideracon that the said Coll Vincent Lowe in his life time that is to say upon the sixth day of November in the yeare of our Lord one thousand six hundred Eighty and Three did oblidge himselfe unto the said Coll Henry Darnall in the penall sume of Twenty thousand pounds of good sound Merchantable Leafe tobacco & Caske by bond under his hand and seale for the makeing over unto the said Coll Henry Darnall and his heirs a good firme and indefeaseable Estate in fee simple in and to one thousand acres of Land to be made Choice by the said Coll Henry Darnall and at his Election out of Either of Certain Tract of Land Pattented by him the said Coll Vincent Lowe the twenty Eighth Day of June one thousand six hundred eighty and three Called the Ladys delight and Lyeing in Ceacill County Contayning & Laid out for three thousand acres or out of an other Tract of Land Laid out for the said Coll Vincent Lowe the sixteenth day of August one thousand six hundred Eighty and Three Called Timber Ridge Lyeing in Ceecill County aforesaid and Contayning by the survey thereof two thousand seaven hundred Acres More or Less and for as Much as the said Coll Henry Darnall has made his Election to have his thousand Acres out of the said Tract of Land Called Timber Ridge they the said James Murphy and Mich.ll Turbutt as Ex.rs as aforesaid Have granted bargained Sold aliened enfeoffed and Confirmed as by these presents doe grant Bargain Sell Alien Enfeoff and Confirme unto the said Coll Henry Darnall All that Tract or parcell of Land part of the aforesaid Tract Called Timber Ridge Begining at the first bound Tree of the said Tract being a White Oake and Runing thence with the first Lyne of the same south west and by west Ninty perches then south fifteen degrees westerly Three hundred and forty perches then south forty foure degrees Easterly foure hundred and Tenn p.rches then south fifteen Degrees westerly untill it meet with the North East and by East Line of the said Tract and then North East and by East with the said Line two hundred and thirty p.rches to the end thereof & from thence with a straight line to the first bound White Oake Contayning & Laid out for one thousand Acres of Land Together with all and singular the Rights Members and appurtenances thereunto belonging or in any wise appertayning To have and to hold the said one thousand Acres with all and singular the p.rmisses unto him the said Coll Henry Darnall his heirs and Assignes for Ever to the onely proper use and behoofe of him the said Coll Henry Darnall his heirs and assignes and to no other use intent nor purpose Whatsoever And the said James Murphy and Mich.ll Turbutt as Ex.rs as aforesaid doe Covenant promiss and agree to and with the said Coll Henry Darnall and his heirs that they the said James & Michaell by vertue of the Power ^and^ Trust exposed in them by the said Coll Vincent Lowe in and by his said Last will & Testement shall and will doe and suffer to be done from time to time and at all times hereafter at the Costs and Charges in the Law for the further assurance and sure Makeing of the p.rmisses & of every part as shall be Reasonably devised or advised by the said Henry his heirs and Assignes for ever In Wittness whereof the said James Murphy and Michaell Turbott have hereunto sett their hands & affixed their seales the day and yeare first above Written
