740 (730 Maryland Memorandum that upon the seaventh day of Aprill in the yeare of our Lord 1696 Came before John Hammond Esq.r one of his Maj.ties Justices of y.e provintiall Court of the Province of Maryland Robert Carvile of S.t Marys County Gent.l And Made Oath on the holly Evangelist that at the time of the fileing of the two Decl and Acco.t on the other Side menconed hee the Deponant had in his Custody faire and uncancilled the bill for 2400 of tobaccoe in the said first Menconed Decl Menconed which was Wittnessed by one W.m Aldren and was Dated as in the same Decl is Specified And hee further saith that at y.e same time hee alsoe had in his Custody faire and uncancelled the bill in the second Decl specified for 1600 of tob Which was Witnessed by one M.r Mathew Scarbrough & was Dated as in the same Decl is Expressed And that since Comeing up to the provinciall Court held at the port of Annapolis in Ann Arrundell County in Octob.r Last past by an unhappy Accident hee Lost his bagg of Writeings which were Fallen Over board and Sunk in the River Severne or a Creeke And that he Doth verryly belive the said two bills ware in the said Bagg and Lost with the same And the said Deponant doth further depose that the Acco.t on the other side is Just and true & that hee did Never receive any part of y.e same or of the 2400 of tobaccoe Due on y.e said Bill or of the other 1600 tobaccoe Save only Eleaven Shillings or thereabouts Ro Carvile Sworne before me The Day and yeare above said Jn.o Hammond Recorded Aprill 8.th 1696 P Henry Wriothesley Clk This Indenture Made the fifth Day of March in the yeare of our Lord one thous.d six hundred Ninety five Beetween Thomas Tench of Ann Arrund.ll County Esq.r of y.e One part and Richard Hill sen.r Marriner of the other part Wittnesseth that the said Thomas Tench for and in Consideracon of the Sume of Forty pounds Sterl to him in hand paid before the Delivery of these p.rsents the Receipt Whereof the said Thomas Doth hereby Acknowledge and Every part and parcell thereof Doth Exonerate Acquitt & Discharge the said Richard hath Bargained Sould Alien Enfeoffe & Confirme as by these p.rsents he doth bargaine sell Alian Enfeoffe and Confirme unto him the said Richard Hill all that p.rll or Lott of Ground in the Port of Annapolis in the said County being Number seaventy Nine and Lyeing to the North west of M.r Henry Constables Lott & at the North East side of Wapping Sheete being that Lott whereon the house stands Whereas the Records and provinciall Court are Now Kept And being the sume that was formerly Entred by Richard Hill Seno.r the Second Day of August one thousand six hundred Eighty Foure Together with all houses thereon Standing and all appartenances whatsoever thereunto belonging or any waise appertaineing To have and To hold the same unto him the said Richard Hill Jun.r his heirs and Assignes for Ever freely and Clearly Exonerated Acquited and Discharged of all Incumbrances Whatsoever And the said Thomas Tench doth for himselfe his heirs Executo.rs and Adm.rs Covenant To and with the said Richard his heirs Ex.rs And Administrato.rs that hee the said Thomas at the time of the Delivery of these p.rsents is seized of the said Lott of Ground of A firme and sure Estate of Inheritance in fee simple and |
