704 (694 William & Mary by the grace of God of England Scotland France and Ireland King and Queene Defenders of the Faith &c To M.r Thomas Tasker Cap.t John Bigger and M.r Francis Freeman Greeting Whereas Samuel Watkins of Calvert County Gent shewed to our Keeper of our great seale of Maryland and Chiefe Judge in Equity that whereas he is now possessed of his Free purchase in his Demeasne of a certain Tract of Land lying in Calvert County called the Ripe conteyning Eight hundred seventy Two Acres of Land and for that there is likely to arise some dispute concerning the true antient meetes and bounds thereof and of some other land thereto adjacent and the Evidences that can prove the same are antient & infirm and cannot attend Courts for that purpose Therefore and in Case of mortallity he humbly supplicated us to provide him some fitt remedy in that Case We have the right fit to Order Constitute and Appoint you the said Thomas Tasker John Bigger and Francis Freeman or any Two of you to call before you at some convenient time and place in Calvert County when to you it shall seem meet such Evidences as the said Samuel Watkins shall nominate & propound and them to examine upon oath by them by you to be administred upon such Interogatoryes as shalbe given you by the said Samuel Watkins of and concerning the p.rmisses and that notice of the time and place be given unto the heir of John Lidiatt late of Calvert County Innholder Decd Mathew Lewis of the same County planter and WIlliam Haines of the said County or their Attorneys to be then and there p.rsent if to them or either of them it shall seem meet to examine or cross examine such Evidences as shall be produced as aforesaid of and concerning the p.rmisses And when you have soe Examined and Cross Examined the Evidences as aforesaid you are to transmitt their Depositions fairly drawn up and close sealed under your hands and seales unto our high Court of Chancery by all convenient speed there to be Registred in perpetuam rei memoriam and for soe doing this shalbe your sufficient power and authority Witness our selves at the Citty of S.t Maryes the six and Twentieth day of July in the sixth year of our Reign &c Annoq Dm 1694 Henry Wriothesley Reg.r in Canc Maryland fs Interogatoryes to be administred to Witnesses to be produced sworn & examined before us underwritten by vertue of a Comission issueing out of their Ma.ties high Court of Chancery to us directed bearing date the six and Twentieth day of July Anno Dm 1694 for and on the behalf of Samuel Watkins of Calvert County Gent touching and concerning a tract of Land of his the said Samuel Watkins lying in Calvert County called the Ripe as followeth viz.t 1.st Did you know Nicholas Harvey of Calvert County planter decd and the Tract of Land whereon he hired called S.t Josephs Mannor and the Meetes and bounds of the same 2.dly Did you know or have you heard where the antient known Road or Path runn called the Potuxent Road or Path over the said Mannor and [illegible] near the same went to the head of S.t Lawrence Creeke to Backe River 3.dly Doe you know or have you heard of a branch issuing out of Back River called S.t Francis Branch and where or in what part of the said Back River comes the same and how came you to know the same to be called S.t Francis Branch |
