(693) 703 Chattells movable & immovable of what kind or nature whatsoever they were whether within doors or without to be wholly hers and at her disposing as by the said Will may more at large appeare and shortly after dyed leaving six Children on the body of the said Ann begotten to wit Richard Joseph Agnes Ann Susanna & Mary Hopewell And whereas the said Agnes is since marryed to one William Jessup Calker and hath already recd satisfaccon for her partable share of her said Fathers & son all Estate and the said said above bound Ann doth shortly intend to the said Joseph & Ann Hopewell the Daughter to allott & pay to them in p.rsent possesion what she doth design to give them for their share in the said psonall Estate And the above bounden Ann being willing & desirous to provide for her said other Children the said Richard Susanna & Mary for the advancem.t of their percons out of the remainder of her said personall Estate and the better to secure the same to them in Case she should happen to dye intestate or should marry againe in such manner & form as is hereafter menconed If therefore the above bounden Ann shall at any time within these six years next ensueing the date of these p.rsents dye before the said six years be expired or marry another husband shall before the expiracon of the said six years cause the psonall Estate she shall then be possessed with to be equally divided by indifferent psons of the neighbourhood into four equall shares or parts one Fourth part to be to the above bounden Ann one other Fourth pte to the said Richard one other fourth pte to the said Susanna and the other fourth pte to the said Mary and of her division thereof shall by writing under her hand & seale or otherwise give & deliver to the said Richard Susanna & Mary their said severall quarter pts soe divided as aforesd to hold to them & their assignes for ever or in Case the said Ann the obligor shall happen to dye before the said six years shalbe expired if then she shall by her last will & testam.t or other writing give and devise to the said Richard Susanna & Mary three fourths of such of her psonall Estate as she shall then be possessed off to be equally divided betweene them as aforesaid share & share like Or further if in Case the above bound Ann shall happen to marry another husband before the said six years shalbe expired as aforesd then if she shall before the Nuptiall be celebrated Cause such of her estate as she shall then be possessed with all to be equally divided by indifferent psons as afd in manner & form afd & shall by writing or otherwise as afd give & deliver to the said Richard Susanna & Mary their sevall fourth pts thereof as afd without any fraude or delay that then this p.rsent obligacon to be voyd & of none effect or else to stand in full force power and vertue provided always that the said Susanna and Mary shall not receive the severall pts or shares of the sd psonall estate before they come to the age of eighteen years or be marryed which shall first happen And in Case the said Susanna & Mary should happen to dye before they come that age or be marryed then the pte & share of her soe dying shalbe equally divided amongst the brothers & sisters that shall survive her sealed signed & delivered the words [Ann & divided] last interlined in Ann A Hopewell the p.rsence of her mark Henry Loftus Record 22.o Dec.r 1694 |
