       By vertue of the within ritten precept I have arrested the within
       menconed shipp now riding at anchor in Great Choptank River
       together with her Tacklin & Furniture as in a Schdule hereunto annexed
       and I have also sumoned the within Named James Aderson Master
       and John Cape M.rchant to appeare here at the returne of the sd precept
       as within comanded the other p.rsons Francis Partis and Comp.a not
       being in my Bayliwick to be found

       frying panns one spitt for sheets maine tacks & fore tacks maine sheets
       top sayle riggine maine top saile clulings maine clugarnetts maine bunklins
       maine top saile sheets fore buntlins & Leislins fore bowlins fore top saile clulm
       fore top saile bowlins fore parrell for clugarnetts fore sheets blacks maine parrell
       the Mizen breles and saceins fore top saile sheete main top saile parrell
       & fore top saile parrell mizen parrell maine sheets blacks maine top saile
       bowlins a quantity of blacks besmet gasketts & points sprum yarne maine
       boulin & fore bowlin bridles three small loue tackles two fore top sailes
       two fore soles two maine sailes two miznes a sprit sole seaven old Musketts
       five old swords a small worme Nine old Lantrens a 4 hour glass
       two hour glass one minute glass one small kettle a parcell of old iron

          And the sd David Mills James Robertson Andrew Banes & John
       Grosse by their Libell by them Exhibitted to the Justices afsd by their
       procurator afsd complained & sett forth that one Charles Partis Marriner
       lately deceased being put Master of the sd shipp one M.r Davison M.rchant
       Alderman of Newcastle afsd & Francis Partis m.rchant & other owners of the
       said shipp and the sd shipp being bound for a voyage to this Province did
       upon the 21 day of Septemb.r 1690 shipp on board & hire for wages the sd
       John Gross steward of the sd shipp and to assist in the Navigation of the said
       mouth and did also upon the 14.th day of Octob.r Following at Leith in the
       Kingdom of Scotland shipp on board & heire for wages the sd Andrew Barnes
       as Carpenter X of the sd shipp dureing the voyage afsd after the rate of three p.ds
       & five shillings sterling by month & did likewise upon the 23.d day of Octobre
       afsd at leith afsd ship on board & heire for wages the sd James Robertson as
       pilote of the sd shipp dureing the sd voyage at the rate of three pounds ster
       by the month & did also upon the 28.th of Octob afsd at Leith afsd ship on
       board and hire for wages the sd David Mills as a Marriner in the sd shipp
       after the rate of Thirty six shillings and six pence ster by the month untill
       the 15.th day of May 1691 and the sd Charles Partis being dead & one James
       Anderson taking the charge of the sd shipp and being made Master thereof
       and one Rober Sharpe being Boatswone of the sd shipp who haveing
       oeft the sd shipp and goeing for England one Jaspur Holey who was Gunner
       of the sd shipp made Boatswone & the sd Davis Milles was made Gunner and
       his wages from the sd 15.th day of May 1691 by the sd James Anderson advanced
       to Fifty shillings p month and shortly after the complainants were soe severally
       shipped & heired as afsd the sd Charles Partis w.th the sd shipp sett saile to this Province
       where they arrived safely in the Port of Patuxent a bott the 21 day of Aprill
       1691 only the sd Charles Partis the Master about three dayes before dyed and there
       was buryed after whose death the sd James Anderson being eldest made w.th the
       consent & good Likeing of M.r John Cape the Cape M.rchant and the consent of the
       shipp crew as the usuall custome upon the like accidents was made Master and
       tooke upon him the charge and Governments of the sd shipp and unto him the
       complainants yeilded all due submission & obedience and after some short
       stay at Patuxent the sd shipp was by the comand of the sd Master & M.rchant
       carryed up the Bay in to Great Choptanck River afsd where the sd John  
       Cape the M.rchant unladed his goods & cargoe & sold the same and the
       servants brought in the sd shipp w.ch were more then of sufficient vallue
       to have purchased her Loading if the sd M.rchant had pleased soe to do
