597) 607 And Whereas likewise the sd Garrett Vansweringen for divers good causes and consideracons him thereunto mooveing by a Certain writeing or Instrument under his hand and seale bearing date the sd 29.th of July 1673 hath also remised released and for ever quitt clayme unto the sd Mark Cordea his Ex.rs Adm.rs & Assignes his full & peaceable pocession & seizin for and dureing the remaind.r of the tearme of yeares and then to come and ^un^expired in the p.rmisses all such right title Interest & demand as the sd Garrett then had or ought to have of in or to all the sd two Messuages or Tenements with the Land thereunto belonging according to the Divisionall bounds afsd by any waies or meanes whatsoever (excepted the sd yearly rent of one Fatt capon which he referred to be paid him every yeare at Christmas afsd by the sd Mark Cordea his Ex.rs Adm.rs or Assignes in forme afsd To have & to hold the sd two messuages or Tenements with the appurtenances unto him the sd Mark Cordea his Ex.rs and Adm.rs to the onely use & behoofe of the sd Mark Cordea his Ex.rs Adm.rs & Assignes for and dureing the remaind.r of the sd tearme of one & thirty yeares under the yearly rent afsd And Whereas the sd Mark Cordea by Indenture under his hand & seale bearing date the 10.th day of October in the yeare of our Lord God 1685 for and in Consideracon of the sume of sixteene thousand pounds of tobacco to him paid by William Digges did grant bargaine sell assigne and sett over unto the sd W.m Digges his Ex.rs Adm.rs & Assignes the afsd two Messuages or Tenements with all and singular the Lands and appurtenances thereunto belonging and all other the p.rmisses or mentioned to be demised and granted by the sd Garrett Vansweringen to the sd John Quigley and by the sd John Quigley to the sd Mark Cordea and by the said Mark Cordea to the sd William Digges in and by the sd Indentures or Deeds Indented and Assignem.t before recited particularly expressed meeted and bounded To have & to hold the sd Messuages or Tenem.ts Lands and p.rmisses with all and singular theire appurtenances before expressed to him the sd William Digges his Ex.rs Adm.rs or Assignes from the day of the date of the sd Last recited Indenture from the sd Mark Cordea to the sd W.m Digges for and dureing the rest & residue of the sd tearme of one & thirty yeares then yet to come and unexpired And Whereas the sd William Digges hath since received a promise or assurance from the R.t Hon.ble Charles Lord Baltemore for the Reversion of the sd two Messuages or Tenements with the appurtenances Lands and p.rmisses Granted by the sd Mark Cordea to the sd William Digges to be granted to him the sd W.m Digges his heires & Assignes for ever And further Whereas Francis Pennington of S.t Maries County Gent haveing taken up a certaine Lott of Land scituate Lyeing and being in the Citty of Towne and Port of S.t Maries Marked Noted & knowne by the Number (43) & duely entred the same with the clerke of the sd Towne and haveing also built thereon a Twenty Foote house in pursuance and according to the directions of a certaine Act of Assembly of this Province Intituled (an act for Advancement of Trade) And Whereas also the sd William Digges haveing taken up a certaine other Lott scituate in the sd Towne or Port of S.t Maryes marked & knowne by the Number (44) and that duely entred the same with the Clerke afsd both which sd Lotts were part or parcell of a greater tract of Land granted by the sd Cecilius Lord Baltemore to him the sd Francis Pennington his heires & assignes for Ever |
