604 (594 This Indenture Made the twentieth day of February in the yeare of our Lord one thousand six hundred Ninety & one Between Edward Middleton of S.t Maryes County Gent of the one part and Philip Lynes of the same county M.rchant on the other part Witnesseth That the sd Edward Middleton for and in consideration of the sume of seaven thous.d pounds of tobacco to him in hand paid at & before the ensealing hereof by the sd Philip Lynes the receipt whereof the sd Edward Middleton doth hereby acknowledged accordingly & himselfe to be thereof and therewith fully satisfyed and thereof and every part thereof doth clearly acquit exonerate & discharge the sd Philip Lynes his heires Executors & Administrators & Every of them for ever by these p.rsents Hath given granted bargained sold aliened enfeoffed and confirmed and by these p.rsents doth fully clearly and absolutely give grant bargaine sell alien enfeoffe and confirme unto the sd Philip Lynes and his heires All that Messuage or tenement and and Plantattion comonly called Evans reserve lying in the Forrest in Choptico hundred in S.t Maryes County and all the lands thereunto Belonging conteyning one hundred acres more or lesse lately bought and purchased by the sd Edward Middleton of & from Edward Evans And all orchards Gardens houses out houses wayes easements proffitts comodityes and appurtenances to the sd Tenement belonging or in any wise apperteining And all woods underwoods timber & timber trees and all Deeds patents writings and evidences belonging or relating thereunto The Conveyance of which Plantation & land was by the sd Evans acknowledged according to law in S.t Maryes County Court in January Court last past To have & to hold the sd messuage or tenement land and Plantation and other the p.rmisses hereby bargained & sold with the appurtenances unto the said Philip Lynes his heires & assignes To the only proper use & behoofe of the sd Philip Lynes his & assignes absolutely and for ever to be holden of the Cheife Lord or Lords of the fee or fees of the p.rmisses by the rents & services therefore due of Right accustomed And the sd Edward Middleton for him & his heires the sd Messuage Land & p.rmisses unto the sd Philip Lynes his heires & assignes against all p.rsons whatsoever shall & will warrant and for ever Defend by these p.rsents And Alsoe the sd Edward Middleton for him his heires Ex.rs & Adm.rs and for every of them doth covenant grant & agree for and with the sd Philip Lynes his heires & Assignes by these p.rsents That he the sd Philip Lynes his heires & Assignes shall & may from hence forth for ever peaceably and quietly have hold occupy possess & enjoy the sd Messuage or tenem.ts land & p.rmisses and every part thereof free & cleare and freely & clearly acquitted exonerated & discharged of & from all & all manner of bargains sales guifts grants titles troubles debts charges and encombrances whatsoever the quit rent from hence forth to become due onely excepted, And further that he the sd Edward Middleton & his heires and all claiming any estate in or to the p.rmisses fall & Will athe request & cost & charges of the sd Philip Lynes his heires or Assignes make & grant unto him or them such further & other assurance or assurances in the law of the afsd p.rmisses as by the said Philip lynes his heyres or Assignes or his or theire councill learned in the law shall be reasonably devised or advised & required all which further assurances shall be & inure & shall be Deemed adjudged construed & taken be & inure to the onely prop.r use and behoofe of the sd Philip Lynes his heires & assignes for ever |
