538 (528 Acknowledge Levy suffer and Execute all and every such further and other lawfull and reasonable Act and Acts Conveyances and Assureances in the Law whatsoever for the further and better Conveying and assureing the said Three Tracts of Land & Premisses with the Appurtenances unto the said William Arbuckle and his Heires to the use of him the said William Arbuckle and of his Heires & Assignes for Ever Be it by fine Recovery or Recoveries Deed or Deeds Acknowledging & Recording these Presents or by any other lawfull wayes or meanes whatsoever as by the Councill Learned in the Law of the said William Arbuckle his Heires or Assignes shall be reasonably devised or advised & required soe as such further assureance Contein or comprize noe further Covenants or warranty then is in these Presents Comprized In Wittnes whereof the parties aforesaid to these Indentures Interchangeably have putt their Hands and seales the day and year first above written Sealed & Delivered in after the words Charles Calvert (sealed or name of William Arbuckle was writt upon the Razure of all and severall places as w.thin in the Presence of us Philip Lynes J Mackeven Tho Grunwin On the back side of the aforesaid recited Deed was Endorsed as foll Memorandum that this Third Day of Aprill 1689 the within Named Charles Calvert did befor us under written Acknowledge the within to be his Act and Deed W.m Joseph W.m Digges Maryland sc Know all Men by these Presents That I Charles Calvert of S.t Maries County in the Province of Maryland Esquire am holden and firmely bound unto William Arbuckle of Glascow in the Kingdome of Scotland Merchant now resident in Maryland in the sume of Fifty Thousand Pounds of Tobacco to be paid to the said William or his Certein Attorney Executors or Assignes To which Payment well and truely to be made I bind me my Heires Executors & Administrators and Every of us firmely by these Presents sealed with my seal Dated the one & Twentieth Day of March in the Year of Our Lord One Thousand six Hundred Eighty and Eight The Condicon of this Obligacon is such That if the above bound Charles Calvert his Heires Executors and Adm.rs doe and shall well and truely pforme fullfill and Keep all and Every the Covenants Graunts Articles and Agreements Conteined and menconed in Certein Indentures of bargaine and sale indented bearing Date the day of the Date above menconed made betweene the said Charles Calvert on the one pt and the above named William Arbuckle on the other part which on the pt and behalfe of the said Charles Calvert his Heires |
