515) 525 And the said Richard Marsham John Hance & Sarah Warren Executors of Bassill Warren by Robert Carvile their Attorney saith that the aforesaid Accon of the aforesaid Edward & Dudley Carleton doe in no wise deny neither but that the said Basill Warren was Receiver of the Goods & Merchandizes of the said Edward & Dudley Carleton and that they the said Ex.rs of Basill Warren to witt Richard Marsham John Hance and Sarah Warren ought to Accompt thereof in manner as the said Edward & Dudley Carleton hath declared against them and further saith that they are and alwais was ready to Accompt thereof as by the following affidavit doth more plainly and at large appeare The Deposition of Thomas Greenfeild Aged forty years or there abouts saith that in December last after the death of M.r Warren being in Company with M.r Marsham M.r Hance Cap.t Holmes & M.r Haws M.r Marsham inquired of M.r Haws whether he had a Letter of Attorney to take the Effects of the Merchants Carleton in case of his sonne Warrens Death M.r Haws said he had none what shall we doe then said M.r Marsham I am Antient & full of Trouble and Care about my owne concernes I wish any one could be found had care to take the Carletons Effects into their Hands provided they would discharge sonne Warrens Estate Cap.t Holmes said he brought in a Gentleman this year who had a Letter of Attorney to that Effect nameing M.r Davis whereupon M.r Marsham & M.r Hance urged M.r Haws to send for the said M.r Davis to bring down his power & instruccon that they might see them & so dispatched a Messenger the next Day Appeared M.r Davis with his Letter of Attorney which upon perusall was thought to be wanting in the Clause commonly used in Letters of Attorney (viz.t) upon receipt of so & so Acquittances Releases and other discharges for me and in ae seal & Deliver whereupon M.r Marsham & M.r Hance told them the danger the Effects might bee in if now soon Looked after And they thought their quickest way would be to give them security such as was sufficient And they would Deliver up the Bookes and Effects to M.r Davis M.r Davis said how shall it be Expected that I shall give security and am altogeather a stranger after severall discourses Cap.t Holmes he would gett security nameing M.r Underwood and asked if hee would do M.r Marsham said yea with any other Resonsable Liver in the Countrey & desired the deponant to draw a writeing to the purpose aforesaid but the Deponant declined thinking himselfe unapt in such a matter after divers other discourses and proposalls M.r Marsham was saying if they would not get security as hee had offered them hey might solicite the Governo.rs for a Speciall Court which he doubted not but their Hono.rs would grant Especially in favo.r to the Merchants Concernes in England and Advised that it might be done with as much forwardness as might bee for the safety of the said Merchants Carltons goods and if they would take that it be the method of their proceeding hee desired then to take downe his sonnes will inclosed in a Letter to his Hono.r Coll Henry Darnall which was done & further your Deponant saith not Tho Greenfeild Jan.ry 4.th 1688 |
