475) 485 This Indenture made the Nineteenth day of September in the Yeare of Our Lord One Thousand six hundred Eighty and Eight Betweene Henry Lowe of Calvert County in the Province of Maryland Gent and Susanna his wife on the one part And the Hon.ble Vincent Lowe of Talbot County Esquire and Anthony Neale of Charles County Gent on the other part Whereas a Marriage hath been lately had and solempnized betweene them the said Henry and Susanna with whome the said Henry was to receive not onely a Considerable Estate by setlement upon him of the land whereof the said Susanna any waies stood seized of before the said Marriage had either in her owne right or in Joynt tennancy or Tennancy in Common with others But also a Competent personall Estate whereof she was Possessed In Consideracon of w.ch marriage and of the Reall and psonall Estate aforesaid The said Henry Lowe hath given sufficient bond of the penalty of fourteene hundred Pounds of lawfull money of England with Condicon for payment unto the said Susanna If she shall survive the said Henry the full summe of seaven hundred Pounds of like lawfull money of England Free of all Debts charges and Encumbrances whatsoever which was to be in full of all Claymes which she might or could Clayme out of the personall Estate or out of the lands tenements or hereditaments of the said Henry Lowe (after his decease) or whereof he should be seized or possessed of Either in right of her the said Susanna or otherwise And alsoe the said Henry Lowe for the Consideracon aforesaid Did by one other bond of the penalty of Four hundred Pounds of Lawfull money of England Oblige himselfe to pay Two Hundred Pounds of like money in case the said Susanna shall bequeath the same away and depart this life and leave the said Henry her surviving as by the same bonds and Condicons severall Relacons being thereunto had more plainely may severally and respectively appear Which agreements was made and Concluded on before the said marriage had and solempnized But the same as to the setlement of the land of the said Susanna (hereafter perticulerly menconed) not yet pformed Now this Indenture witnesseth That for and in Consideracon of the aforesaid marriage And of the bonds given for Payment of the said sumes of seaven hundred Pounds and Two Hundred Pounds sterl and in part of performance of the aforesaid Agreements before marriage made as aforesaid And for setleing & Assureing the lands tenements and hereditaments herein after named to and upon the said Henry Lowe as is hereafter expressed And for the sume of five shillings sterl to them the said Henry and Susanna in hand paid by the said Vincent Lowe and Anthony Neale before the Ensealing hereof And for divers other good causes and Consideracons him the said Henry and Susanna his wife thereunto moveing They the said Henry Lowe and Susanna his wife Have Given grannted bargained Sold Aliened Enfeoffed and Confirmed And by these presents doe Give Grant bargaine sell ^alien^ enfeoffe and Confirme unto the said Vincent Lowe and Anthony Neale and their Heires All that parcell of land called Greene Oake lying in Cæcill County on the East side of Chesepeake Bay on the westerne side of Sasafrax River upon the southward branch of a Creeke called fishing Creeke Beginning at a marked Beech on a poynt and Running south and by west for breadth up a long the branch Two Hundred and Twenty pches to a marked white Oake from the said Oake by a line drawne south East for length Three Hundred and twenty pches by a line drawne from the said south East line North and by East Two Hundred twenty five pches by a line drawne from the North and by East line North west unto the first marked Beech Three Hundred and twenty pches Conteyning and layd out for Four Hundred and fifty Acres more or lesse Grannted by Pattent bearing date the Third Day of March 1661 All that parcell of Land called Holdmanstone lying in Cæcill County on the East side of Chesepeake bay on the west side of a River in the said Bay called Sasafrax River Begining at a marked Oake upon a poynt by the mouth of a Creeke for breadth downe the River One Hundred pches to a marked Oake bounding on the North by a line drawne west south west from the said Oake for length Three Hundred and Twenty pches on the west by a line drawne south East from the end of the west south west line untill it Intersect a parrallell drawne from the said Creeke on the south with the said Creeke and parallell on the East with the said River Conteyning and layd out for Two Hundred Acres more or lesse Alsoe all that parcell of Land called Southward lying in Cæcill County on the East side of Chesepeake bay and on the south side of a River in the said Bay called Sasafrax River Begining at a marked Oake upon a poynt by a greate Belly of Marsh Running South East downe the River for breadth seaventy five pches to a marked oake by a Marsh bounding |
