317) 326 Cheife Governo.r of the Province And the other part thereof to the said Nehemiah Blackiston and Samuel Cooper who aswell for our Soveraigne Lord the King and the said Lord Prop.ry Cheife Governo.r aforesaid as for themselves prosecute according to the forme of the statute aforesaid And whereas also the said goods ship with her furniture and apparrell have beene and are by vertue of a Comission from the said Court appraised to the sume of Four hundred and twelve pounds Nineteene Shillings and Tenn pence out of which deduct the sume of Three hundred Sixty seaven pounds and four shillings for Seaven wages by the Judgem.t of the said Court Ordered to be allowed and discounted there onely remained to be divided as aforesaid the sume of Fourty five pounds Fifteene shillings and Tenn pence That is to say One third part to our said soveraigne Lord the King one third part thereof to the sayd Lord Prop.ry Cheife Governo.r as aforesaid and the other part thereof to the said Nehemiah Blackistone and Samuel Cooper who aswell &c as by the Record of the same Court relation thereunto being had more planely & more at large it doth and may appeare And whereas the said Nathaniel Davis hath payd unto the said William Stevens for the use of his Maj.ty for his third part of the said Forty Five pounds Fifteene Shillings and Tenn pence the sume of Fifteene pounds Five shillings and three pence and to the said Henry Darnall for the use of the Lord Prop.ry Cheife Governo.r aforesaid the like sume of Fifteene pounds five shillings and three pence for his Lordsp thm.r part thereof and to the said Nehe Blackiston for the use of himselfe and the said Samuel Cooper who aswell &c the like sume of fifteen pounds five shillings & three pence residue of the said sume of Forty Five pounds Fifteene shillings and Tenn pence for their third part thereof in full satisfaccon of shipp and goods appraised as aforesaid Now Know yee that Wee the said William Stevens for and on the part and behalfe of our said Soveraigne Lord the King Henry Darnall for and on the part and behalfe of the said Lord Prop.ry Cheife Governo.r as aforesaid and the said Nathaniel Blackiston for himselfe and Samuel Cooper Doe by these p.rsents for and in Consideracon of the p.rmisses Release & discharge the said ship Ossery of Londonderry and all her guns Tackle amunicon furniture & apparrell and the goods aforesaid from the arrest seizin accon Judgem.t and Condemnacon aforesaid and the said ship with all her guns tackle amunicon furniture and apparrell and the goods aforesaid Doe fully clearly & absolutely grant to the said Nathaniel Davis the Master aforesaid In Testimony whereof wee have hereunto Sett Our hands and Seales the Ninth day of Aprill in the Tenth yeare of the Dominion of the Right hon.ble Charles Lord Baltemo.r &c Annoq.r Dm 1685 Sealed & delivered by the within named William Stevens Esq.r in the p.rsece of Micaya Browning William Graham Robert King William Davison In behalfe of the said Lopps part Henry Darnall (sealed) Sealed & delivered by the within named Henry Darnall Esq.r in the p.rsence of In satisfaccon of the third part to the Informer I doe onely Hen Phipps in my owne private Capacity subscribe hereunto Sam.ll Matthews Nea Blackiston (sealed) Sealed and deliverd by the within named Nehemiah Blackiston Esq.r in the p.rsence of Robert Black John Will Robert Sly his Timothy d Richison marke |
