(226) 236 And the said Thomas Trueman by Robert Carvile his Attorny Cometh and defendeth the force and Jury when &c and prayeth liberty to Imparle hereunto untill next Provinciall Court and it is granted unto him the same day is given to the Plaintiffe likewise Now here att this day to witt the seaventh day of March in the seaventh yeare of the Dominion of the Right honoble Charles absolute Lord & Prop.ry of Provinces of Maryland and Avalon Lord Baron of Baltemore &c Annoq Dm One thousand six hundred Eighty & one Came the said Plt & Defend.t by their Attornys aforesaid and the said Thomas Trueman by the said Attorny sayth that in the Record and Process and alsoe in the Rendring of Judgem.t aforesaid it is in nothing Erred &c And hereupon the Record and Process to the Rendring Judgem.t thereupon & the aforesaid Causes and matters by the aforesaid Plaintiffe for Erro.rs assigned being read and heard and by the Justices here fully understood and diligently Examined and for that it appeareth to the same Justices that in the Record and Process aforesaid and alsoe in the Rendring of Judgem.t it is manifestly Erred Therefore It is Considered that the Judgem.t aforesaid for the Erro.rs in the Record Process and proceedings aforesaid be Revoaked adnulled and all together held for nothing and that the said John Abington unto all things which by occasion thereof hee hath lost be Restored and alsoe that the said John Abington Recover against the said Thomas Trueman the sume of Two thousand one hundred ninety five pounds of Tobacco for his Costs & Charges by him in this behalfe layd out and Expended John Abington Memorand that at a Provinciall Court held att the Citty of S.t Marys the Eleaventh ag.t day of May in the Fifth year of the Dominion of Charles absolute Lord and Prop.ry of the William Kidd Provinces of Maryland and Avalon Lord Baron of Baltemore &c Annoq.r Dm One thousand One thousand Six hundred and Eighty before his Lopps Justices of the Provinciall Court Came John Abington of Calvert County by Robert Ridgely his Attorny and Exhibiteth to the Court here a certaine Transcript of the Record of Calvert County Court in a Cause there lately depending between John Abington aforesaid Plt and William Kidd Defend.t upon an Informacon Exhibited in the said Court of Calvert County by the said Abington against the said Kidd upon the breach of an Act of Assembly Entituled an Act relateing to servants and slaves the tenno.r of which Record followeth in these words viz.t Att a Calvert County Court held at Calvertowne the Twentyeth day of January in the fifth year of the Dominion of the R.tt honoble Charles & Annoq.r Dne One thousand six hundred seaventy Nine By his Lopps Justices thereunto appointed and authorized viz.t
William Kidd & Joseph Baker acknowledge themselves bound unto the R.tt Honoble the Lord Prop.ry each of them in the full sume of Twenty pounds of lawfull mony of England to be leavyed on their goods and Chattles lands and Tenem.ts in case the said William Kidd appear not att the next Court to answer unto John Abington upon a Certaine Informacon Att a Calvert County Court held att Calvert Towne the seaventeenth day of March in the fifth year of the Dominion of the R.tt honoble Charles &c Annoq.r Dne One thousand six hundred seaventy Nine By his Lopps Justices thereunto appointed & authorized viz.t
