137 (128 still doth altogether denye and refuse to pay the same Contrary to the aforesaid Act of Assembly and to the losse and dammage of the said Thomas Eleaven hundred pounds of Tobacco And thereupon hee bringeth his suite And the said Richard Walker by Abraham Combe his Attorney Cometh and defendeth the force & Injury when &c and Sayth the said Thomas Lomax his accon aforesaid against him ought not to have for that hee sayth that the said Thomas Lomax in his declaracon aforesaid Sayth that the said Richard Hart was indebted to him for Attornyes fees seaven hundred pounds of Tobacco by Account herein Court produced Which account Ought to bee filed w.th y.e declaration Yet for further plea the said Richard Walker Sayth hee did not Transport the s.d Hart out of this province of is guilty of the breach of the said Act of Assembly And his hee is ready to aver and prayeth Judgment of the Court whether the said Thomas his accon aforesaid ought to have Abraham Coombe
Thomas Lomax made Oath in open Court that the aforewritten Acco.t is a Just & true acco.t and that hee hath received noe part nor parcell thereof Now here att this day (to witt) the fourth day of September in the third yeare of the Dominion of Charles &c Came the said parties by theire Attorneyes aforesaid and the said Richard Walker sayth as in the plea aforesaid and of this hee prayeth the Judgm.t of y.e Court If the said Thomas Lomax his accon aforesaid against him ought ^to have^ and the said Thomas Lomax Likewise Hereupon is the Judgm.t of the Court here that the said Richard Walker is guilty in breaking the act of Assembly in Conveying away Richard Hart out of this province therefore it is Considered by the Court here That the said Thomas Lomax Recover against Richard Walker as well the sume of seaven hundred pounds of Tobacco dammages occasioned by ye Trespas aforesaid as also the sume of three hundred ninety seven pounds of Tobacco for his Costs and charges about this suite Expended And further more It is the Judgm.t of the Court here If the said Richard Walker can procure or bring over Richard Hart into this Province by the Last of October next (till wch time) stay of Execucon is grannted Then this Judgment to bee voyd or else Execucon Vera Copia P John Manley Clk And hereupon ^cause^ as well the said Richard Walker by Christopher Rousby his Attorney as the said Thomas Lomax by Kenelm Cheseldyn his Attorney And the said Richard Walker sayth That in the Record and proces aforesaid as in the Rendring of Judgment aforesaid It is manifestly Erred in this First That Whereas the said Defendant is sued upon a penall statute of this province for y.e Breach of the same unto wch hee hath pleaded not guilty and thereupon both parties Joyned Issue and putt themselves upon the Court The Justices have given Judgment against the said Defendant (w.thout |
