Annotated Code of Maryland
(1971 Replacement Volume and 1974 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 5 of Article 44A - Housing
Authorities, of the Annotated Code of Maryland (1971
Replacement Volume and 1974 Supplement) be and it is
hereby repealed and re—enacted, with amendments, to read
as follows:
Article 44A - Housing Authorities

When the governing body of a city adopts a
resolution as aforesaid, it shall promptly notify the
mayor of [such] ITS adoption. Upon receiving [such]
notice, and approving [said] THE resolution, the mayor
shall appoint five persons as commissioners of the
authority created for [said] THE city. The
commissioners who are first appointed shall be designated
to serve for terms of one, two, three, four and five
years, respectively, from the date of their appointment,
but thereafter commissioners shall be appointed as
aforesaid for a term of office of five years except that
all vacancies shall be filled for the unexpired term.
No commissioner of an authority may be an employee
(except a professional educational employee of the city
school system or, in Baltimore City, an employee of the
department of housing and community development or of any
city agency succeeding to its functions) or an elected
officer of the city for which the authority is created.
HOWEVER, IN SOMERSET COUNTY, MEMBERS OF THE COUNCILS OF
INCORPORATED CITIES MAY SERVE AS COMMISSIONERS OF THE
HOUSING AUTHORITY OF THEIR CITY. A commissioner shall
hold office until his successor has been appointed and
has qualified. A certificate of the appointment or
reappointment of any commissioners shall be filed with
the clerk and [such] THE certificate shall be conclusive
evidence of the due and proper appointment of [such] THE
commissioner. A commissioner shall receive no
compensation for his services, but he shall be entitled
to the necessary expenses, including traveling expenses,
incurred in the discharge of his duties.
The powers of each authority shall be vested in the
commissioners [thereof] in office from time to time.
Three commissioners shall constitute a quorum of the
authority for the purpose of conducting its business and
exercising its powers and for all other purposes.
