children under the age of eighteen years living at the
death of such member, then to (his] THE MEMBER'S
dependent father or dependent mother as the board in its
discretion shall direct to continue for life, a pension
of fifty per centum of his average final compensation.
If [such] THE member at the time of his death shall not
leave a [widow] SURVIVING SPOUSE, child or children under
the age of eighteen years or dependent parent or parents,
the ordinary death benefit shall be the only death
benefit payable.
(c) [Provided, however, that the] THE cost of
special death benefits provided herein, exclusive of
benefits for members whose death arises out of or in the
course of actual performance of duty, shall be paid as
follows: The State of Maryland shall pay the cost of
[such] THE special death benefits, including normal
contribution rate and accrued liability rate, provided
[such] THE cost is not in excess of the current
employer's contribution rate for federal old age and
survivors' insurance; any excess in cost of [such] THE
special death benefits over the current rate for old age
and survivors' insurance shall be paid by the members.
[Provided further that the] THE State of Maryland shall
pay the full cost of special death benefits applicable to
members whose death arises out of or in the course of
actual performance of duty.
53.
(12) Upon the receipt of proper proofs of the death
of a member who was retired under the provisions of
subsection (1) or (3) of this section on or after July 1,
1965, there shall be paid child's insurance benefits,
[widow's] SURVIVING SPOUSE'S insurance benefits, mother's
insurance benefits, parents' insurance benefits and
lump—sum death payments which are computed and paid in
accordance with the provisions of Title II of the federal
Social Security Act as in effect at the time of payment,
provided that the average monthly wage upon which [such]
THE benefits are based is deemed to be the lesser of one
twelfth the member's average final compensation or the
maximum average monthly wage then in effect. The amount
of benefits payable under this subsection shall not
include any type of cost—of—living adjustments that the
federal government may provide.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1975.
