LAWS OF MARYLAND
[Ch. 49
OF THIS ARTICLE.
REVISOR'S NOTE: This subsection is new language
added for purposes of clarity and conformity.
Section 18—202 of this title incorporates by
reference §7—402 of this article, which latter
section requires duplicate bills of lading to
be identified by a "conspicuous" notation on
its face. By adopting the U.C.C definition
of "conspicuous" for purposes of this title,
similar notation requirements of §§ 18-205 and
18—302, which relate to nonnegotiable bills of
lading and duplicate warehouse receipts, can
readily be conformed and given a more
definitive leaning, a desirable result in
light of the criminal penalties imposed for
violations of these sections.
(0) GOODS.
"GOODS" MEANS ALL THINGS WHICH ARE TREATED AS
MOVEABLE FOR THE PURPOSES OF A CONTRACT OF STORAGE OR
TRANSPORTATION.
REVISOR'S NOTE: This definition is new language
added for purposes of clarity and conformity.
It repeats with no changes the definition of
"goods" contained in §7—102 for purposes of
Title 7 of this article, which title was
derived in part from the Uniform Bills of
Lading and Warehouse Receipts Acts. Since the
provisions of present Articles 14 and 14A (now
Subtitles 2 and 3 of this title) were once a
part of these Acts, use of the term in
Articles 14 and 14A would appear to have been
intended to have the meaning stated in §7—102.
See Official Consent to §7—102.
(E) PERSON.
"PERSON" INCLUDES AN INDIVIDUAL, CORPORATION,
BUSINESS TRUST, ESTATE, TRUST, PARTNERSHIP, ASSOCIATION,
TWO OR MORE PERSONS HAVING A JOINT OR COMMON INTEREST, OR
ANY OTHER LEGAL OR COMMERCIAL ENTITY.
REVISOR'S NOTE: This subsection is new language
setting forth a broad, standardized definition
of the word "person" as used in this article.
It is a synthesis of the U.C.C. definitions of
"person" and "organization" contained in
§1-201 (28) and (30) of this article, except
that the reference to "government or
governmental subdivision or agency" is not
