15-603. DISCHARGE OF EMPLOYEE BECAUSE OF ATTACHMENT
PROHIBITED IN CERTAIN CASES.

(A) IN GENERAL.

AN EMPLOYER MAY NOT DISCHARGE HIS EMPLOYEE BECAUSE
THE EMPLOYEE'S WAGES ARE SUBJECTED TO ATTACHMENT FOR ANY
ONE INDEBTEDNESS WITHIN A CALENDAR YEAR.

(B) PENALTY.

ANY EMPLOYER WHO WILLFULLY VIOLATES THE PROVISIONS
OF THIS SECTION IS GUILTY OF A MISDEMEANOR AND ON
CONVICTION IS SUBJECT TO A FINE NOT EXCEEDING $1,000 OR
IMPRISONMENT NOT EXCEEDING ONE YEAR OR BOTH.

REVISOR'S NOTE: This section presently appears as
Art. 9, §31(b).

For purposes of conformity, the term
"attachment" is substituted for the more
narrow "garnishment."

The only other changes are in style.

GENERAL REVISOR'S NOTE

In revising this subtitle, the Commission to Revise
the Annotated Code concluded that present Art. 9, §32,
which relates to wages of nonresidents, is unnecessary in
light of the new definition of "employee" in §15—601.
Consequently, Art. 9, §32 is proposed for repeal.
