14-304. CIVIL LIABILITY.

ANY PERSON WHO VIOLATES ANY PROVISION OF THIS
SUBTITLE IS LIABLE TO THE PERSON AFFECTED BY THE
VIOLATION FOR ALL DAMAGES PROXIMATELY CAUSED BY THE
VIOLATION AND FOR REASONABLE ATTORNEY FEES INCURRED BY
THE PERSON DAMAGED.

REVISOR'S NOTE: This section presently appears as
the second sentence of Art. 83, §31. The first
sentence of that section now appears in
§14-305.

14-305. PENALTY.

ANY PERSON WHO WILLFULLY VIOLATES ANY PROVISION OF
THIS SUBTITLE IS GUILTY OF A MISDEMEANOR AND, IN ADDITION
TO THE INJUNCTIVE BELIEF PROVIDED FOR IN TITLE 13,
SUBTITLE 4 OF THIS ARTICLE, OR CONVICTION IS SUBJECT TO A
FINE OF NOT MORE THAN $1,000 OR IMPRISONMENT OF NOT MORE
THAN ONE YEAR OR BOTH.

REVISOR'S NOTE: This section presently appears as
the first sentence of Art. 83, §31.

The reference to "injunctive relief" is
substituted for "actions enumerated" for
purposes of clarity.

The only other changes are in style.

The Commission notes that the penalties
imposed by this section on persons "who
willfully violate" this subtitle are identical
to the penalties imposed by §13—411 on persons
"who violate" the provisions relating
generally to unfair or deceptive trade
practices. Since violation of this subtitle
also constitutes an "unfair or deceptive trade
practice" — see, §§ 13—301(10) and 14-302 —
the General Assembly may wish to conform the
two standards of violation.

14-306. SHORT TITLE.

THIS SUBTITLE MAY BE CITED AS THE MARYLAND
DOOR-TO-DOOR SALES ACT.
