LAWS OF MARYLAND

[Ch. 49

AT THE DIRECTION OF THE ATTORNEY GENERAL, THE
DIVISION MAY:

(1)    IN ACCORDANCE WITH §13-205 OF THIS
ARTICLE, ADOPT REASONABLE RULES AND REGULATIONS
APPROPRIATE TO EFFECTUATE ANY PROVISION OF THIS SUBTITLE,
WHICH RULES AND REGULATIONS, HOWEVER, MAY NOT EXTEND,
MODIFY, OR CONFLICT WITH THIS SUBTITLE OR ITS REASONABLE
IMPLICATIONS; AND

(2)   GRANT TO A SALES AGENCY AN EXEMPTION FROM
ANY REQUIREMENT OF THIS SUBTITLE IF THE SALES AGENCY USES
A PROGRAM WHICH IS APPROXIMATELY AS OR MORE COMPREHENSIVE
THAN THE PROGRAM OF UNIT PRICING REQUIRED BY THIS
SUBTITLE.

(B) VIOLATION OF RULES OR REGULATIONS.

A PERSON WHO WILLFULLY VIOLATES ANY RULE OR
REGULATION OF THE DIVISION, IN ADDITION TO ANY OTHER
PENALTY PROVIDED, IS SUBJECT TO THE SAME PENALTY
APPLICABLE TO VIOLATION OF THE PROVISION OF THIS SUBTITLE
TO WHICH THE RULE OR REGULATION RELATES.

REVISOR'S NOTE: This section presently appears as
Art. 83, §2lE(e).

In subsection (a) (1) of this section, a
reference to the specific procedures of
present Art. 83, §20E — now contained in
§13—205 of this article — is added. Since the
unit pricing provisions are presently a part
of the Consumer Protection Act they are
subject to these rule—making provisions. The
incorporation by reference is necessitated,
therefore, by reason of the transfer to this
title of the otherwise generally independent
unit pricing provisions. See, also, revisor's
note to §14—107 and general revisor's note to
this subtitle.

Also, in subsection (a) (1) of this section,
the word "necessary" is deleted as unnecessary
in light of the disjunctive reference to
"appropriate."

The only other changes are in style.
