held illegal, invalid or unconstitutional or inapplicable
to any person or circumstances, such illegality,
invalidity, unconstitutionality, or inapplicability shall
not affect or impair any of the remaining provisions,
sentences, clauses, sections or parts of this Act or
their application to other persons and circumstances. It
is hereby declared to be the legislative intent that this
Act would have been adopted if such illegal, invalid or
unconstitutional provision, sentence, clause, section or
part had not been included therein, and if the person or
circumstances to which the Act or any part thereof is
inapplicable had been specifically exempted therefrom.

Sec. 3. Effective date.

This Act shall take effect on the 76th day following
the date on which it becomes law.

AN ACT to add a new Article IV, title "Housing
Opportunity Act," to Chapter 56, title "Urban Renewal and
Community Development," of the Montgomery County Code
1972, to follow immediately after Article III thereof, to
declare the necessity of assisting persons who lack
sufficient income to afford decent, safe and sanitary
dwelling accommodations without overcrowding in obtaining
such housing within Montgomery County; to authorize and
empower the County to provide such assistance; to provide
that public funds may be expended by the County for the
purpose of constructing, acquiring or otherwise
encouraging the construction of decent, safe and sanitary
dwelling accommodations for sale or rent to persons of
eligible income; to define persons of eligible income; to
provide that the Housing Authority or any successor
thereto may be designated by the county to carry out
opportunity housing projects; to authorize the County to
provide for the creation of public non-profit corporate
body or bodies, to carry out opportunity housing
projects; to define the powers and duties of the County,
and any corporate body with the authority to utilize
public funds in the exercise of such powers and
authority, in carrying out the purposes of this Act,
including acquiring property, borrowing money, issuing
