Board on the member's eligibility to receive such pension
is final and any questions on whether the member should
be terminated or reinstated shall not be considered in
such hearing. Appeal procedures provided in the
Personnel Regulations shall be followed in making and
handling appeals. There shall be included in the
County's budget any additional amount required to pay
such pension.
(d) Discontinued service benefits of elected
and appointed members. Effective November 1, 1971,
should an elected or appointed member, with ten or more
years of credited service not be reappointed or
re-elected, the member may elect, regardless of age, in
lieu of the return of member contributions with credited
interest, to receive a pension commencing immediately, or
for an elected member enrolling on or after January 22,
1974, commencing at age sixty, equal to two percent of
final earnings, multiplied by years of credited service,
up to a maximum of thirty—six, plus sick leave credits,
but not less than three hundred dollars monthly. There
shall be included in the County's budget any additional
amount required to pay such pension.
SECTION XIV. Sections 46(b), title "Spouse's and
children's benefits of a member whose death is service
connected" and 46(f), title, "Remarriage of spouse", are
hereby amended to read as follows:
(b) Spouse's and children's benefits of a member
whose death is service connected. If a member dies while
in the service of the County or participating agency on
or after August 15, 1965, and satisfactory proof to the
County Personnel Board that death was the result of
injuries sustained in the line of duty or was directly
attributable to the inherent hazards of the duties
performed by the member is submitted and the death was
not due to willful negligence, payments effective March
1, 1974, will be made as follows:
(1) A spouse's benefit equal to twenty—five
percent of the member's final earnings at the time of
death, but not less than two hundred fifty dollars per
month until death or remarriage, plus
(2) A child's benefit equal to five percent
of the member's final earnings but not less than fifty
dollars per month until age twenty—one or for life if the
child is disabled and incapable of self—support.
The maximum total spouse's and children's benefit
shall not exceed forty percent of the member's final
earnings at the time of death.
