BEFORE REPAIR OF THE HOME APPLIANCE.

REVISOR'S NOTE: This section presently appears as
Art. 83, §21H.

In subsection (a)(2), the phrase "but not
limited to" is deleted as unnecessary since
use of the word "includes" is not intended in
any sense to be exclusionary or limiting. The
maxim of expressio unius est exclusio alterius
and doctrines of similar implication are not
intended, therefore, to be made applicable by
reason of this deletion.

In subsection (a)(3), reference to a "company,
or corporation" is deleted as unnecessary in
light of the definition of "person" contained
in §13-301.

With respect to inclusion of this section as
an "unfair or deceptive trade practice,"
subject to the general provisions of this
title, see revisor's note to §13—304.

The only other changes are in style.

As to appliance service contracts, see also
§14-1106.

13-308. ELECTRICAL APPLIANCES.

(A)   SYMBOL OF TESTING LABORATORY REQUIRED.

A PERSON MAY NOT SELL OR DISTRIBUTE AN ELECTRICAL
CONSUMER PRODUCT WHICH IS INTENDED ULTIMATELY FOR THE
PERSONAL USE OF A CONSUMER IN OR AROUND A PERMANENT OR
TEMPORARY HOUSEHOLD OR RESIDENCE, UNLESS THE PRODUCT IS
CLEARLY LABELED, MARKED, OR STAMPED WITH THE SYMBOL OF AN
ELECTRICAL TESTING LABORATORY WHICH IS CERTIFIED BY THE
STATE FIRE MARSHAL TO TEST PRODUCTS TO DETERMINE THAT
THEY ARE SAFE FOR USE.

(B)    ENFORCEMENT BY ATTORNEY GENERAL AND STATE FIRE
MARSHAL.

(1)   THE ATTORNEY GENERAL AND THE STATE FIRE
MARSHAL SHALL EACH ENFORCE THIS SECTION UNDER THE
ENFORCEMENT POWERS PROVIDED IN THIS TITLE AND IN ARTICLE
38A OF THE CODE.

(2)    THE FIRE DEPARTMENT OF BALTIMORE CITY
SHALL REPORT TO THE DIVISION ANY VIOLATION OF THIS
SECTION WHICH IT FINDS.
