and re—enacting, with amendments. Section 31—13, title
"Authority of county executive or his designee to
regulate by signs," to provide that the county executive
or his designee may provide by written regulation in the
form of traffic orders for the erection of official signs
prohibiting or regulating parking on county property or
any privately owned parking lot within the County, which
parking lot is open to and used without charge by members
of the general public for parking in connection with
shopping or for retail commercial establishments; and
that any traffic order issued by the County Executive may
require that the owner, tenant, or employees of retail
establishments furnish evidence necessary for the
enforcement of such order; and Section 31—34, title
"Impounding vehicles after enumerated violations
generally," to provide for the impounding of vehicles
parking in violation of an official sign.
BE IT ENACTED BY THE COUNTY COUNCIL FOR MONTGOMERY
COUNTY, MARYLAND, that -
Sec. 1. Section 31—13, title "Authority of county
executive or his designees to regulate by signs," of
Chapter 31, title "Motor Vehicles and Traffic" of the
Montgomery County Code 1972, is hereby repealed and
re—enacted, with amendments, to read as follows:
Section 31—13. Authority of county executive or his
designee to regulate by signs.
(a) The county executive or his designee is hereby
authorized by written regulation in the form of traffic
orders to prohibit and otherwise regulate parking of
vehicles on county property by the erection of
appropriate signs to effectuate the same.
(b) The county executive or his designee may
provide by written regulation in the form of traffic
orders for the erection of official signs regulating
parking on any privately owned parking lot within the
County, which parking lot is open to and used without
charge by members of the general public for parking in
connection with retail commercial establishments, or
other businesses to which the parking lot is appurtenant.
Any traffic order issued under this section may require
that the owner, tenant, or employees of retail or
commercial establishments furnish evidence necessary for
the enforcement of such order.
Section 2. Section 31—34, title "Impounding
vehicles after enumerated violations generally," of
Chapter 31, title "Motor Vehicles and Traffic" of the
