FLOW FROM THE IMPROPER, INCOMPLETE, OR UNTIMELY
RESTITUTION BY THE VIOLATOR TO THE CONSUMER OF MONEY,
PROPERTY, OR OTHER THING RECEIVED FROM THE CONSUMER IN
CONNECTION WITH A VIOLATION OF THIS TITLE;

(11)   EXERCISE AND PERFORM ANY OTHER FUNCTION,
POWER, AND DUTY APPROPRIATE TO PROTECT AND PROMOTE THE
WELFARE OF CONSUMERS; AND

(12)   IN ACCORDANCE WITH §13-205 OF THIS SUBTITLE,
ADOPT RULES, REGULATIONS, AND STANDARDS WHICH:

(i) ARE NECESSARY TO ASSURE THE ORDERLY
OPERATION OF THE DIVISION; AND

(11) FURTHER DEFINE UNFAIR OR DECEPTIVE TRADE
PRACTICES FOR PURPOSES OF THIS TITLE.

REVISOR'S NOTE: This section presently appears as
Art. 83, §20C.

In item (2), the reference to "frauds" is
deleted as unnecessary, since, under §13—301,
a fraud is within the leaning of "unfair or
deceptive trade practice."

In items (3), (4), and (12), cross-references
are added for purposes of clarity. Although
these items are generally repetitive of the
referenced sections, they are retained for
informational purposes as part of this
section's general checklist of the Division's
powers and duties.

Item (4) is reworded to conform its
terminology to that of the rest of this title.

In item (9), the defined term "consumer goods"
is substituted for the inconsistent "consumer
merchandise," and, in item (11), the word
"necessary" is deleted as unnecessary in light
of the word "appropriate" which is used by the
present section in the disjunctive.

The last sentence of present §20C(5) — which,
as enacted by Ch. 609, Acts of 1974, provides
that rules, regulations, and standards shall
be effective 60 days after their adoption — is
deleted as unnecessary in light of Ch. 600,
Acts of 1974, which enacted the State
Documents Law. See, e.g.. Art. 40, §40A and
Art. 41, §256-I which, to similar effect as
present Art. 83, §20C, provide generally for
deposit of all rules and regulations with the
