CHARTER AMENDMENT NO. 4
"Overlapping Terms for Councilmen"
A resolution of the Mayor and Council of The Town of
Hampstead, Maryland, adopted pursuant to the authority of
Article 11—E of the Constitution of the State of
Maryland, 1957 edition as amended, to amend the Charter
of The Town of Hampstead, this amendment to be entitled
"Overlapping Terms for Councilmen," such being the fourth
amendment to that charter, by repealing and re-enacting
with amendments Section 42 "Number, selection, term," and
Section 71 "Election; date," of the Code of Public Local
Laws of Carroll County, 1965 edition as amended, said
amendment to provide for overlapping terms of office for
councilmen.
Section 1. Be it resolved by the Mayor and Council
of The Town of Hampstead, Maryland that Section 42
"Number, selection, term," of the Code of Public Local
Laws of Carroll County, 1965 edition as amended, be
amended by repealing it and re-enacting it to read as
indicated below. All words to be added are capitalized.
All words to be deleted are enclosed within single
brackets.
42. Number, selection, term.
All legislative powers of the town shall be vested
in a council consisting of five councilmen who shall be
elected as hereinafter provided, WITH ELECTIONS SCHEDULED
SO THAT APPROXIMATELY ONE HALF OF THE COUNCIL IS ELECTED
EVERY TWO YEARS, and who shall hold office for a term of
four years or until the succeeding council takes office,
EXCEPT THAT THREE OF THE COUNCILMEN ELECTED IN 1975 WILL
SERVE FOR TERMS OF TWO YEARS. [Councilmen holding office
on January 13, 1959, shall continue to hold office for
the term for which they were elected and until the
succeeding council takes office under the provisions of
this charter.]
Section 2. And be it further resolved that Section
71 "Elections; date," of the Code of Public Local Laws of
Carroll County, 1965 edition as amended, be amended by
repealing it and re—enacting it to read as indicated
below. All words to be added are capitalized. All words
to be deleted are enclosed within single brackets.
