(B)        UNINTENTIONAL [[OVERCHARGE]] NONCOMPLIANCE BY

SELLER OR HOLDER.

(1)       IF THE SELLER OR ANY SUBSEQUENT HOLDER
UNINTENTIONALLY AND IN GOOD FAITH FAILS TO COMPLY WITH
ANY PROVISION OF §§ 12-504 THROUGH 12-507 THE HOLDER MAY
CORRECT THE ERROR WITHIN 10 DAYS AFTER:

(i) HE NOTICES IT; OR

(ii) THE BUYER NOTIFIES HIM IN WRITING OF THE
ERROR.

(2)         IF THE HOLDER CORRECTS THE ERROR WITHIN
THE 10-DAY PERIOD, HE MAY NOT BE SUBJECT TO ANY PENALTY
UNDER THIS SUBTITLE.

REVISOR'S NOTE: This section presently appears as
Art. 83, §153F(a).

The word "seller" is deleted as unnecessary in
light of the definition of "holder" in
§12-501.

With respect to the substitution of "finance
charge" for "service charge," see revisor's
note to §12-501(f).

The only other changes are in style.

12-514. JURISDICTION OF COMMISSIONER OF CONSUMER CREDIT.

(A)   INVESTIGATION OF COMPLAINT.

IF A COMPLAINT FOR VIOLATION OF ANY PROVISION OF
THIS SUBTITLE IS FILED WITH THE COMMISSIONER OF CONSUMER
CREDIT, HE MAY INVESTIGATE THE COMPLAINT AND HOLD A
HEARING ON IT IN ACCORDANCE WITH ARTICLE 83, §162 OF THE
CODE.

(B)   NOTICE OF HEARING.

THE COMMISSIONER SHALL GIVE TO THE PERSON COMPLAINED
AGAINST AT LEAST 10 DAYS WRITTEN NOTICE OF THE COMPLAINT
AND THE TIME AND PLACE OF ANY HEARING. THE NOTICE SHALL
BE IN WRITING AND SENT BY REGISTERED OR CERTIFIED MAIL TO
HIS PRINCIPAL PLACE OF BUSINESS.

(C)   CEASE AND DESIST ORDER.

(1) IF, AFTER THE HEARING, THE COMMISSIONER
FINDS THAT THE PERSON HAS ENGAGED OR IS ENGAGING IN ANY
ACT OR PRACTICE PROHIBITED BY THIS SUBTITLE, HE SHALL
ORDER THE PERSON TO CEASE AND DESIST FROM THE ACT OR
