MUNICIPAL CHARTERS

In addition, the Town of Elkton agrees (1) to permit
the property owners, Joseph Mullan and Getty Mullan, his
wife, their heirs, successors and assigns, to connect
into the Big Elk Interceptor, i.e. a 24" sewer main as
located on a plat entitled "Figure 2" contained in the
Report dated August 23, 1973, of H.H.B. Day Engineers,
Inc., said connection or tap in point to be located upon
Town lands (formerly owned by Cox) where the sewer main
converges with the line of the lands of the Penn Central
Railroad Company and the Big Elk Creek, and (2) to grant
an easement through Town lands (formerly owned by Cox) to
permit the aforesaid property owners, their heirs,
successors and assigns, to run a sewer line from the
aforesaid connection or tap in point through the said
Town lands to the property being annexed herein. Joseph
Mullan and Getty Mullan, his wife, their heirs,
successors and assigns, shall build and construct in
accordance with Town specifications a sewer line running
from said connection point to the property annexed herein
at their sole expense and in lieu of a front foot
assessment being imposed upon said property in making
sever services available to said property.

Section 5. AND BE IT FURTHER RESOLVED that the area
to be annexed is zoned as outlined in the attached plat,
R-2.

Section 6. AND BE IT FURTHER RESOLVED that the
Mayor and Commissioners of the Town of Elkton will hold a
public meeting in regards to the enactment of this
Resolution on May 8, 1974 8:00 P.M. in the Town Hall of
the Mayor and Commissioners of the Town of Elkton,
Elkton, Maryland.

Section 7. AND BE IT FURTHER RESOLVED that the date
of adoption of this Resolution is May 8, 1974 8:00 P.M.,
and the amendment to the charter of the Town of Elkton by
the Mayor and Commissioners of Elkton hereby proposed by
this enactment shall become effective forty-five (4 5)
days after final enactment, unless a proper petition for
a referendum hereon shall be filed as permitted by law,
provided a complete and exact copy of this Resolution
shall be posted in the Town Hall of Elkton until and
PROVIDED, FURTHER, that public notice of the contents of
this Resolution shall be published in the "Cecil Whig" or
"Cecil Democrat," a newspaper of general circulation in
the Town of Elkton, once in each of the weeks of March
27, April 3, 10, 17, 1974.

Section 8. AND BE IT FURTHER RESOLVED that the
Mayor of the Town of Elkton be and he is hereby
specifically enjoined and instructed to carry out the
provisions of Section 7 hereof, and, as evidence of said
compliance, the Mayor and Commissioners of the Town of
