MUNICIPAL CHARTERS

SOUTH 04° 12' 56" EAST 164.87 FEET, THENCE SOUTH 85°
36' 18" EAST 66.00 FEET TO A POINT IN THE OUTLINE OF
THE TRACT CALLED, "HOWELL POINT" (HASTINGS FARM),
SAID POINT ALSO MARKS THE WESTERNMOST BOUNDARY LINE
OF THE CORPORATE LIMITS OF THE TOWN OF BETTERTON;

THENCE, WITH SAID OUTLINE, THE FOLLOWING TWO (2)
COURSES AND DISTANCES,

SOUTH 03° 18' 53" EAST 957.71 FEET TO A STONE FOUND
MARKING THE COMMON CORNER OF THE LANDS OF HAROLD J.
KENNEDY, ET UX, RECORDED IN LIBER E.H.P. 38, AT FOLIO
243, AND LOUIS P. CREW RECORDED IN LIBER W.H.G. NO. 63,
FOLIO 10, THENCE

SOUTH 02° 52' 54" EAST 1393.19 FEET TO THE PLACE OF
BEGINNING, CONTAINING 308.623 ACRES OF LAND INCLUDING THE
ROAD KNOWN AS HOWELL POINT ROAD AND PORTION OF IDLEWILLE
AVENUE, EXTENDED REFERRED TO HEREIN AS "PRIVATE ROAD".

PROVIDED, MOREOVER, THAT PERSONS RESIDING IN THE
AREA, AND THEIR PROPERTY, AND THE OWNERS OF PROPERTY
THEREIN, SHALL BE SUBJECT TO THE PROVISIONS OF THE
CHARTER OF BETTERTON, AND SUCH PERSONS AND THEIR PROPERTY
SHALL BE SUBJECT TO MUNICIPAL TAXATION AND SHALL BE
ENTITLED TO MUNICIPAL SERVICES AND FACILITIES EQUAL TO
SUCH TAXATION IMPOSED AND SUCH SERVICES AND FACILITIES
PROVIDED TO OTHER RESIDENTS AND PROPERTY OWNERS OF SAID
TOWN; SUBJECT TO THE FOLLOWING CONDITIONS AND
CIRCUMSTANCES:

A.     THE TOWN OF BETTERTON SHALL MAKE WATER SERVICE
LINES AVAILABLE TO THE EASTERN PERIMETER OF HASTINGS
FARM.

B.       CHESAPEAKE PROPERTIES, OWNERS OF HASTINGS
FARM, SHALL INSTALL THE FOLLOWING FACILITIES AT NO
EXPENSE TO THE TOWN OF BETTERTON, SUBJECT TO DESIGN AND
ENGINEERING SPECIFICATIONS ESTABLISHED BY SAID TOWN,
WHICH FACILITIES SHALL BE DEDICATED TO SAID TOWN UPON
CONNECTION WITH THE MUNICIPAL SYSTEMS THEREOF:

(1)      A SEWER LINE FROM EASTERN PERIMETER OF
HASTINGS FARM TO PRESENT MUNICIPAL SEWAGE TREATMENT PLANT
ADEQUATE IN SIZE TO HANDLE THE WASTE-WATER FROM ALL
RESIDENCES EXPECTED TO BE CONSTRUCTED ON SUCH FARM, AND
IF NECESSARY CAUSE TO MODIFY OR INSTALL A NEW PUMPING
STATION TO HANDLE SUCH EFFLUENT.

(2)    ALL WATER AND SEWER LINES INTERIOR TO HASTINGS
FARM, INCLUDING CONNECTION TO MUNICIPAL SYSTEMS.

C.     ALL IMPROVED PROPERTIES WITHIN THE ANNEXATION
