BERWYN HEIGHTS
FOR A TERM OF TWO YEARS OR UNTIL THE SUCCEEDING COUNCIL
TAKES OFFICE. THE REGULAR TERM OF COUNCILMEN SHALL
EXPIRE ON THE THIRD TUESDAY OF MAY FOLLOWING THE ELECTION
OF THEIR SUCCESSORS,
(E) QUALIFICATIONS
1. EACH COUNCILMAN, ELECTED OR APPOINTED,
SHALL CONTINUE TO HOLD OFFICE FOR SUCH TERM OR TERMS SO
ELECTED OR APPOINTED TO, SHALL HAVE ATTAINED THE AGE OF
TWENTY-FIVE YEARS, SHALL BE A CITIZEN OF THE UNITED
STATES, SHALL HAVE RESIDED IN THE TOWN FOR AT LEAST SIX
(6) MONTHS IMMEDIATELY PRECEEDING THEIR ELECTION, SHALL
BE QUALIFIED VOTERS OF THE TOWN AT TIME OF NOMINATION,
AND MUST CONTINUOUSLY RESIDE IN SAID TOWN DURING HIS OR
HER TERM OF OFFICE.
2. NO COUNCILMAN SHALL, DURING THE TIME FOR
WHICH HE IS ELECTED, BE APPOINTED TO ANY PAID OFFICE OR
POSITION IN THE SERVICE OF THE TOWN. NO OFFICER OR
EMPLOYEE IN THE SERVICE OF SAID TOWN OR OF ANY
MUNICIPALITY IN THE STATE OF MARYLAND SHALL CONTINUE IN
SUCH POSITION AFTER BECOMING A CANDIDATE FOR ELECTION FOR
COUNCILMAN.
(F) TITLE, PROPERTY. THE AFOREMENTIONED BODY OF
FIVE COUNCILMEN SHALL BE KNOWN AS THE MAYOR AND COUNCIL
OF BERWYN HEIGHTS. All acts and things done on behalf of
said Town shall be in the name of the Town of Berwyn
Heights, by the MAYOR AND COUNCIL OF BERWYN HEIGHTS, and
all property purchased or otherwise acquired by said Town
shall be purchased, acquired, and held in the name of the
Town of Berwyn Heights.

Pursuant to Article 11E of the Constitution of
Maryland and Section 13 of Article 23A of the Annotated
Code of the State of Maryland, (1957 Edition as amended),
the Commissioners of the Town of Berwyn Heights desire to
clarify the language of and assure that various
provisions in the Town Charter are consistent with state
and federal laws and court decisions,
