encumbered, and that "any unexpended or unencumbered
funds.... may be.... retained as a contingent fund not
to increase "to a total of more than fifty thousand
dollars ($50,000.00)" by eliminating the fifty thousand
dollar ($50,000.00) limitation.

SECTION 1. BE IT RESOLVED BY THE COMMISSIONERS OF
BEL AIR, MARYLAND, That Section 128, entitled "Tax Rate,
Budget" and more particularly subsection (L) thereof be
and it is hereby amended as follows:

Section 128. Tax Rate: Budget

(L) LAPSED APPROPRIATIONS.

All appropriations shall lapse at the end of the
budget year to the extent that they have not been
expended or lawfully encumbered. Any unexpended or
unencumbered funds shall be considered as surplus at the
end of the budget year and all or part thereof may be
included among the anticipated revenues for the next
succeeding budget year or retained [as] IN a contingent
fund [provided that the contingent funds of the Town of
Bel Air shall not thereby be increased to a total of more
than fifty thousand dollars ($50,000.00)] AT THE
DISCRETION OF THE COMMISSIONERS OF BEL AIR.

SECTION 2. AND BE IT FURTHER RESOLVED by the
Commissioners of Bel Air, That the date of the adoption
of this resolution is the 28th day of October, 1974, and
the Amendment of the Charter of the Town of Bel Air
hereby enacted shall become effective on the 13th day of
December, 1974, unless proper Petition for Referendum
hereon shall be filed as permitted by law, provided, that
a complete and exact copy of this Resolution shall be
continuously posted on the bulletin board at the Town
Office until the 13th day of December, 1974; and provided
further that a copy of the title of this Resolution shall
be published in a newspaper of general circulation in the
Town of Bel Air, once in each of four (4) successive
weeks hereafter.

SECTION 3. AND BE IT FURTHER RESOLVED, That the
Chairman of the Commissioners is hereby specifically
enjoined to carry out the provisions of Section 2 hereof,
and as evidence of such compliance, the said Chairman
shall cause to be affixed to the minutes of this meeting
appropriate certificates of publication of the newspaper
or newspapers in which the title of this Resolution shall
have been published and shall declare the Charter
Amendment hereby enacted to be effective by affixing his
