Smoking - Elevators

FOR the purpose of prohibiting smoking on public
elevators; authorizing the Commissioner of Labor and
Industry to promulgate rules and regulations; and
establishing penalties for violations.

Dear Mr. Speaker:

In accordance with Article II, Section 17 of the
Maryland Constitution, I have today vetoed House Bill
707.

This bill prohibits the smoking of tobacco products
in any elevator whose use is available to the general
public.

Senate Bill 504, which was enacted by the General
Assembly and signed by me on May 15, 1975, accomplishes
the same purpose. In addition, while House Bill 707
provides that the proprietor of a building "shall
prohibit the smoking of tobacco products" in public
elevators. Senate Bill 504 takes what seems to be the
wiser course by providing that the proprietor must "post
a sign" informing the public that smoking in the elevator
is illegal and subject to a monetary penalty.

The sponsor of House Bill 707 has also indicated to
me that the language of Senate Bill 504, in his opinion,
is more practical than that of House Bill 707.

For these reasons, I have decided to veto House Bill
707.
