GENERAL REVISOR'S NOTE

In revising this subtitle, the Commission to Revise
the Annotated Code decided to retain Art. 49, §5(b) in
its present Code allocation, with but minor
cross—referential amendment, pending future revision and
reallocation to the Business Regulation Article.

SUBTITLE 2. SMALL LOANS - CREDIT PROVISIONS.

12-201. DEFINITIONS.

(A)   IN GENERAL.

IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.

REVISOR'S NOTE: This subsection is new language used
as the standard introductory language to a
definition section.

(B)   LENDER.

(1)         "LENDER" MEANS A PERSON WHO MAKES A LOAN
UNDER THIS SUBTITLE.

(2)      FOR PURPOSES OF §§ 12-205 AND 12-210 OF
THIS SUBTITLE, "LENDER" INCLUDES EACH LICENSED PARENT,
SUBSIDIARY, OR AFFILIATE OF A LENDER.

REVISOR'S NOTE: Paragraph (1) of this subsection is
new language added to indicate that, in this
subtitle, the term "lender" relates only to a
person who makes a loan under the provisions
of this subtitle and not, for example, under
any other credit law.

Since there are some persons who are permitted
to make loans without a license (see revisor's
note to §12—202), the Commission concluded
that, in this subtitle, the somewhat more
meaningful term "lender" should be substituted
